المستخلص: عرف الاستحسان بتعريفات عدة، اختلفت فيها عبارات الفقهاء، ومن خلالها حكم على حجيته، أيعد دليلا شرعيا، أم أن العمل به عمل بمقتضى الهوى، ولذا كان إنكار العمل به عند البعض، مرده إلى الحقيقة المتصورة له، واعتباره عند الـبعض الآخر من خلال ما تصوروه له من مفهوم، إلا أنه لم ينكر استعمال الجميـع للفـظ الاستحسان في كتبهم، لوروده في القرآن الكريم والسنة النبوية، فضلا عـن وروده في إطلاقات أهل اللغة والاجتهاد، ولذا أخذ بالاستحسان كحجة يـستدل بهـا علـى الأحكام الشرعية عند الجميع، سواء في هذا من قال بحجيته أو من أنكرهـا، و قـد اتفق الجميع على عدم حجية الاستحسان القائم على هواجس النفس أو الأهـواء أو عادة الناس من غير دليل معتبر من أدلة الشرع، أو الاستحـسان المخـالف لهـذه الأدلة، أما ما تقتضيه أدلة الشرع المعتبرة من استحسان فإنه يعد حجة في الأحكـام الشرعية عند جميعهم، ولذا قال بعض العلماء: لا يكاد يوجد معنى للاستحسان الذي استعمله الفقهاء يصلح أن يكون محل نزاع بينهم .

In Islamic jurisprudence, the “way of preference” (Istihsan) has many definitions with contradictory attitudes of Muslim jurists. Some of Islamic legal advisers refuse to give this way any value, under consideration that it gives the jurist an authority to deduct according to his personal taste. This controversy is founded on the contradictory concepts given to the ‘way of preference” as an independent source of legal opinion. But in fact, the jurists use the term “preference” in their books, likewise the Quran, the Sunnah and the Arab linguistic erudite are using it. This linguist concept makes from the “Preference” an authentic instrument, between other sources, to deduct many precepts of the Sharia. In unanimity, all the jurists reject the opinion resulted by “preference” if it’s not assisted by another approved legal source, or when, in evidence, it contradicts the fundamental Islamic principles. In other hand, they accept any deduction by “way of preference” when it’s clearly appropriate with the spirit of Islam. And then, some erudite declare that it’s not fair to speak about controversy on the real essence of the “way of preference”.
