This research consists of an introduction dealing with the technical and linguistic definition of guardianship to contract marriage and other two chapters. The first of them considers the limited guardianship, and explains whether a woman has the legal capacity to contract by herself for her marriage and the Islamic Jurisprudencial opinion in this regard. The second chapter discusses the extended guardianship to contract for marriage on behalf of a minor, an adult virgin and a woman who has been married before. It also considers the Islamic Jurisprudencial opinion and the legislative trend in this concern. |
