تعد مسألة تسبيب السلوك الإجرامي إحدى المسائل النظرية المهمة في القانون الجنائي، فهي تكشف من ناحية عن الأسباب الداخلية (السيكولوجية) لجريمة محددة (نشوء الدافع)، ومن ناحية ثانية تبين دينامكية تطور الفعل الإجرامي ذاته، بدءاً باتخاذ القرار (بالعزم) على التزام سلوك معين، وحتى تحقق النتائج التي يعاقب عليها القانون. كما تتجلى أهميتها لدى البحث في الأسباب الكامنة وراء ارتكاب الجريمة، إذ يستند استظهار الحقيقة في القضية الجنائية في المرتبة الأولى على الكشف عن دوافع الجريمة المقترفة وأهدافها. إن أهمية البحث في دوافع الجريمة وأهدافها تبرز في ارتباطهاً بجملة من القضايا المهمة في القانون الجنائي، ومنها أساس المسؤولية الجنائية وتفردها، واستظهار الركن المعنوي للجريمة، والأهلية الجنائية، والظروف المستبعدة لخطورة الواقعة، وفرز مراحل النشاط الإجرامي. إن الهدف المطروح في هذا البحث ينحصر في دراسة دوافع الجريمة وأهدافها، وإبراز أهميتها في النشاط الإجرامي، وتحديد دورها في تكييف الجرائم، وفي تفريد العقاب. لذلك تم توزيعه على مبحثين، كرس الأول منهمالا، وفي مطلبين، لتحديد ماهية كل من الدافع والهدف، وأفرد الثاني، وفي مطلبين أيضاً، لبيان أهميتهما في تكييف الجرائم، وفي تفريد العقاب.
