|a تعد حماية الغير من الضرر غاية التشريعات التي تفرض الوسائل لبلوغ تلك الحماية ومنها فرض التزام عام بعدم إيقاع الضرر وبالمقابل فان حماية الفرد كما تكون بعدم الإضرار تكون، بمنع الضرر عنه ومن هنا تأتي أهمية التأكيد على الإنقاذ حيث كونه عملا ايجابيا يوْدي الى منع وقوع الضرر وضرورة ان يلزم القانون بهذا العمل وعادة يأتي الالتزام بالإنقاذ أي بمنع وقوع خطر الضرر قبل وقوعه، وجب تشريعات خاصة او ان يرد الالتزام بالانقاذ في بعض العقود كما في التزام المستعير في انقاذ المال المعار او في عقد تعليم السباحة وغيرها.
