المستخلص:	The cultural property of countries and peoples are considered as its lasting credit of experiences , experiments and attitudes that give the human capacity to face the present and imagine the future. But that property is facing today in many countries, especially those that has an ancient civilization such as Iraq ,to a number of threats to their survival and persistence as a testament to the human civilization at different stages.and comes on top of these risks the destruction and damage during armed conflict, as well as illicit trafficking in such property. States in order to maintain their cultural,have two legal ways, the first work on the issuance and the development of internal legislation, which states that no destruction or damage or distortion, or drilling or change the features or separate part thereof, and not to dispose them ,and not to export them abroad without the permission of the competent authorities, while the second trend is based on international treaties and conventions. \
