يعني هذا البحث بدراسة حقوق الطفل، وعلاج المشكلات التي يواجهها دراسة تأصيلية شرعية. ويهدف البحث إلى: إظهار منهج القرآن الفريد في عرض قضايا حقوق الإنسان بعامة، وحقوق الطفل بخاصة، وتأصيلها تأصيلاً قرآنياً، وإظهار سبق القرآن الكريم لجميع المنظمات والاتفاقيات. وانتهج البحث: المنهج الوصفي التحليلي، والمنهج التاريخي. وتوصل إلى نتائج، من أهمها: أن تعريف علم النفس للطفولة ليس صحيحاً، ولا يتوافق مع اللغة، ولا مع الاصطلاح الشرعي، بل ولا يتفق مع طبيعة التغييرات الفسيولوجية لدى الإنسان. وأن القرآن الكريم سبق جميع منظمات واتفاقيات حقوق الطفل بخاصة وحقوق الإنسان بشكل عام. وأن وفاء القرآن الكريم بحقوق الطفولة وعلاج مشكلاتها وفاء عام شامل؛ ليكون قاعدة عامة في كل مكان وزمان. ومن أهم التوصيات: الدعوة إلى عقد المؤتمرات والندوات الدولية؛ لإبراز أثر الإسلام وإسهاماته في قضايا حقوق الإنسان. والإفادة من تسارع عجلة التطور المعاصر، واستخدام جميع وسائل الإعلام؛ لنشر الثقافة الإسلامية الخاصة بحقوق الطفل، والإفادة منها في دعوة الناس إلى تعاليم هذا الدين الحنيف.
This research aims at studying childhood rights and solving related problems in the light of Shari’ah. It highlights the special approach that the Holy Quran uses to present the human rights in general and the child’s rights in particular. Also, it shows that the Qur’an has recognized such rights long before organizations and conventions. Methodologically, this research applies descriptive, analytical and historical approaches. The following are important findings. Firstly, the psychology definition of childhood is inadequate from the linguistic and Shari’ah points of view. It is not consistent with the nature of human physiological changes. Secondly, the Qur’an has confirmed these rights long before all organizations and conventions concerned with children’s rights in particular, and human rights in general. Thirdly, the Quran values childhood rights and it offers comprehensive solutions applicable to all places and times. The following are important recommendations. This research paper recommends that the role and contributions of Islam in promoting human rights issues be highlighted in international functions and conferences. Secondly, communication advances should be made use of to spread Islamic teachings, especially those related to children’s rights.
