كُرِّس هذا البحث لدراسة العِلَّة بين تنقيح المناط وتخريجه؛ وهما من أهم أنواع الاجتهاد في العِلَّة، والتي تُعدَّ من أهم موضوعات علم أصول الفقه الإسلامي. وقد ركَّزت هذه الدراسة على إيضاح مفاهيم هذه المصطلحات، مع ضرب الأمثلة عليها، كما قارنتها بما يقاربها من المفاهيم الأصوليَّة الأخرى؛ وذلك لتحديد أهميتها ودورها الأصولي بشكل أوضح. وبالإضافة إلى ذلك قام الباحث بإظهار الحكم الشرعي للتعبد بها في نظر العلماء، ثمَّ إظهار الفروق بينها، واتجه الباحث فيها اتجاهاً أصولياً تحليلياً مدعماً بالبعد الفقهي المقارن في كل المسائل ذات الصلة، وقد تمخَّضت هذه الدراسة عن نتائج مهمة تتمثل برسم منهج تطبيقي إجرائي لتخريج المناط، بشكل قابل للتطبيق في البحث المعاصر، هذا بالإضافة إلى منهج عملي لتنقيح المناط، وقد طبقت هذه المناهج على جملة من عِلل الأحكام ذات الأثر التطبيقي الواسع في التعامل المعاصر، ثمَّ رُبطت بتطبيقاتٍ فقهيَّة معاصرة لهذه العِلل المستنبطة، وقد جاءت الدراسة في سبعة مباحث، ومقدمة، وخاتمة.
This research is devoted to study two of the types of reasoning that concern the effective cause, al-‘Illah. The first of which is Takhrij al-Manat i.e. extracting the cause. The second is Tanqih al-Manat i.e. clearing the cause from any external feature. These issues are regarded as being vital and important in the Science of the Principles of Islamic Jurisprudence. This study sheds light on the concepts of these terms with providing several examples for them. In addition, it offers a comparison between the terms of the three types of cause reasoning, as well as some other relevant technical terms. This is in order to specify their importance and role in this field of study in a clearer way. Moreover, this project highlights the point of view of the scholars of this science regarding the legitimacy of using and applying them. Furthermore, this research clarifies the differences between the three categories of reasoning that relate to the cause including the third type Tahqiq al-Manat i.e. ascertaining the cause. This project reaches to a significant outcome which is deriving a consistent method for applying is Takhrij al-Manat and Tanqih al-Manat in a practical sense which is able to be applied in the contemporary research. The methods derived are implied on several causes of rulings that have broad applications in the contemporary life. The causes derived are connected then with some important modern legal implications from the financial life. However, this paper consists of seven sections, an introduction and conclusions.
