المستخلص: The first who had legalized deducing by presumption the legal riles was Imam Al- Baqhir ( P.U.H ), depending on the narrations that had been narrated for him. Finding out whether presumption is a speculation proof, a foqahatic proof or a achieving principle comes throughout revealing the narrations that proved the presumption authority. Before that date, there was nothing but the legislation stage. The difference among these three levels had important effect such as the authority of the mental requirements of speculative …..Many scholars had followed Al- Na`iny in believing on presumption as achieving principle which is the third opinion upon presumption consideration, yet he believed on the difference between the verbal speculative and the actual speculative. It appears that the difference lies in weakness and strength, hence the authority of the infallible say is stronger than the authority of his act.
