الحمد ﷲ؛ والصلاة والسلام على رسول اﷲ؛ نبينا محمد؛ وعلى آله وصحبه ومن اتبع هداه، أما بعد: فقد جاءت الشريعة الإسلامية بالحث على عمل الخير، والإنفاق في سبيل اﷲ، ومن ذلك توقيف الأموال وتحبيسها على أبواب البر والإحسان، ومنه الوقف الذي يعد من الصدقات الجارية في حياة المتصدق وبعد وفاته. وللأوقاف الإسلامية أهمية كبرى في حياة الأمة دنيا وآخرة، أما في الآخرة؛ فلما رتب على الإنفاق بصفة عامة والأوقاف بصفة خاصة من الأجور العظيمة التي يستمر جريانها ونفعها للموقف في حياته وبعد وفاته، وأما في الدنيا؛ فللأثر الكبير للأوقاف في حياة المسلمين، من سد حاجات المحتاجين، وعوز المعوزين، والقيام بشؤون الأرامل والأيتام، وتشييد المساجد ودور العلم والمصحات وحفر الآبار وإنشاء الطرق والسدود والقناطر، والسقايات وإجراء المياه، والقيام بشؤونها لتستمر إشعاعا للرعاية العلمية والصحية والاجتماعية. ولما كان للوقف هذه المنزلة العظيمة والعائد الطيب للواقف في الدنيا والآخرة، جاءت هذه الدراسة لتحديد المشكلات التي تواجهها أوقاف الجمعيات والمؤسسات الخيرية بمنطقة الرياض، ومن ثم العمل على علاجها أو التخفيف من آثارها، وقد تبين أن منها ما يعود للواقف، ومنها ما يعود للناظر، ومنها ما يعود للموقوف عليهم، ومنها ما يعود للجهات ذات العلاقة بالوقف. وتكون مجتمع الدراسة من مسئولي الجمعيات والمؤسسات الخيرية، وعددهم بمنطقة الرياض يزيد على (١٧٠) ما بين جمعية ومؤسسة خيرية وفرع مكتب، وفيها الجمعيات والمؤسسات المرخصة من وزارة الشؤون الاجتماعية، وجمعيات تحفيظ القرآن ومكاتب الدعوة وتوعية الجاليات بمنطقة الرياض. وأظهرت الدراسة العديد من النتائج أبرزها: صعوبة التصرف في الوقف بالبيع أو الاستثمار من قبل الجهات الحكومية ذات العلاقة عند تعطل منفعة الوقف، عدم تعاون الجهات الحكومية ذات العلاقة بالوقف عند الحاجة لإصلاحه أو نقله أو تطويره، عدم وجود آليات واضحة لتوظيف الوقف في التنمية الاجتماعية والمعرفية والصحية وغيرها، عدم وجود تنظيم يسهل تسجيل الوقف في الشؤون الإسلامية والتصرف فيها، ضعف التوعية الإعلامية بالوقف وفضله وأهميته وأحكامه وأنواعه وأثره

The study population consisted of officials associations and charitable organizations, and their number in Riyadh over (١٧٠) between the Assembly and charity and Branch Office, and the associations and institutions licensed by the Ministry of Social Affairs, and associations Koran and the offices of advocacy and education communities in Riyadh.
