تبرز بشكل واضح أهمية موضوع بحثنا ( التحقيق الابتدائي في جرائم الصحافة ) (دراسة مقارنة ) في أن الصحافة تمثل أهم وسائل حرية التعبير عن الرأي ومؤشرها الرئيس , فتسمو قيمة حرية الصحافة إذا تناسبت قيودها مع ضماناتها , وان حرية الصحفي تتطلب وضع معيار دقيق وعادل للموازنة بين مصلحتين أحدهما حق الإفراد في حرية التعبير عن أرائهم وأفكارهم مع ضمان عدم تهديدهم أو المساس بهم إذا ما سلطوا الأضواء على التجاوزات والسلبيات التي تقع من قبل السلطات العامة في الدولة , بينما تتصل الأخرى بحق الدولة والمجتمع في الدفاع عن مصالحه التي ينالها العدوان إذا ما تحولت هذه الآراء والأفكار إلى وسيلة للنيل من الحقوق والمصالح العامة والخاصة ولمعرفة الإجراءات الجزائية الخاصة بمساءلة الصحفي والتوفيق بين المصلحتين المذكورتين أعلاه اخترت هذا الموضوع
