In this paper, I tried to clarify the confusion that usually comes in minds between the subject matter upon which the protection appears and between the authors or in wide sense the owner of the right who is the beneficiary of such a protection. Then I moved to identify the legal nature of the term "work" by examine its meaning both in the national and the international level. In the middle of the paper I discussed in a great detail the categories of the protected subject matter under the English law and its comparison with the Sudanese law. Then I went to the requirements for granting of copyright protection and at that point I limited myself in discussing only the originality requirement and leaving formal requirements as it is almost universally accepted that they are not fundamental issues in obtaining copyrightability. After all I debated the unprotected copyright subject matters under Sudanese and English law. Finally, I tried to raise the question of Islam and Christianity as possibly accepted grounds in finding a cause for refusing to grant the legal protection and this was the end of my research paper. |
