تهدف هذه الدراسة إلى التعرف إلى نمط التفاعلات التي رافقت السلوك التـصويتي الـدولي داخل مجلس حقوق الإنسان على قضية الحرب على قطاع غزة 2008/2009، وتوضيح مـا إذا كانت المصالح القومية وأهداف السياسة الخارجية للدول تؤسس لحالة من الانسجام والتوافق تجاه قضية الدراسة أم لا، إضافة إلى التعرف على أثر تقرير (غولدستون)، على عملية التصويت في المجلس، وبيان تأثير الدول الكبرى على مجريات التصويت، واعتماداً على موضوع الدراسة، فقد أجابت عن تساؤل مؤداه ما أثر المصالح القومية المتضاربة للدول على السلوك التصويتي للدول الأعضاء في مجلس حقوق الإنسان؟ وخلصت الدراسة إلى نتيجة رئيسية بأن الحرب الإسرائيلية على قطاع غزة شكلت نوعاً مـن عدم الالتزام بقواعد القانون الدولي الإنساني واتفاقيات جنيف، حيث نتج عنها انتهاك لقواعـدهما. وأن المصالح القومية للدول هي التي تحكم توجهات سلوكها التصويتي في مجلس حقوق الإنسان.
This study aimed at pointing out the relationship between the members of human rights council that would establish a state of harmony and concordance towards the case study, through pointing out the voting situation of the member states on human rights council's decisions towards the Palestinian case in general and Gaza in particular. In order to reach to the objectives and targets of the study, the study relied on some scientific methods in order to know the international system method, the quantitative (statistical) method, and the legal method. The study was based on a major hypothesis that there is a correlation between solidarity and harmony of voting behavior between member states and their interests and objectives, which consequently affect the independence of HCR. The study concluded that despite the international concern towards the protection of human rights and basic freedoms, there are international and national interests that have impact on their attitudes towards voting at the HCR. This study answered the questions on the problems of the study, and confirmed the validity of its hypotheses. It also concluded a set of recommendations that will help in upgrading the level of cooperation among the Arab countries and other member countries at the council to build relations that will contribute in achieving political solidarity in favor of the Palestinian case in the lobbies of the UN bodies in general and HRC in specific.
