|b This paper will identify the prevailing health problem caused by orphan diseases throughout developing countries and the crisis of orphan drugs for curing it as the patent is seen as great obstacle for drug distribution and public access. The thesis will also specify the international agreements concerning right to public health and its Implementation associated with TRIPS Agreement under World Trade Organization regulatory framework. A comparative study of the legislative frameworks of both developed and developing countries will reveal to what extent United States of America, Canada, the European Union, Brazil, Russia, India, China and South Africa conformed with patent protection exceptions arising from international patent law to protect public health by ensuring available and easy access to life safeguarding medicine.
