After the adoption of 106-98 safeguard at importation Act by the Tunisian Parliament, there was a great doubt on its applicability. Tunisia has to strike balance between the requirement of protecting the national branch which might be overwhelmed by foreign importations and the necessity of respect some tough legal conditions. Seven years later, it turned out that Tunisia managed to enforce safeguard mechanism against some products. Tunisia has first adopted surveillance procedures before deciding the opening of two enquiries which didn’t lead to safeguard measures. |
