|b According to this guarantee, the property developer in the frame of a completed property sale contract, shall guarantee the vices which might appear in the building at an estimated time of a year from the date of the building possession by the purchaser. This guarantee contains also the good working of equipement pieces of the building as well as the lacks of conformity of the constructed property to the contractual terms and to art laws. The new guarantee is characterised by its objectivity and its conformity to the public order

|a موجب هذا الضمان، يلتزم المرقي في إطار عقد بيع عقار مبني بضمان ما قد يظهر في البناء من عيوب خلال أجل سنة واحدة ابتداء من تاريخ حيازة البناية من طرف المقتني، ويمتد هذا الضمان ليشمل أيضا حسن سير عناصر تجهيز البناية، فضـلا عن عيوب المطابقة طالما أنه يهدف إلى تحقيق مطابقة العقار للشروط التعاقدية ولقواعد الفن. ويتسم هذا الضمان الجديـد بأنـه ضمان موضوعي ومرتبط بالنظام العام.

|d Selon cette garantie, le promoteur s’oblige dans le cadre d’un contrat de vente d’immeuble achevé à garantir ce que pourra apparaitre de vices dans le bâtiment lors d’un délai d’une année à partir de la date de possession du bâtiment par l’acquéreur. Cette garantie contient aussi le bon fonctionnement des éléments d’équipement du bâtiment ainsi que les défauts de conformité tant que celle-ci vise à assurer la conformité de l’immeuble construit aux clauses contractuelles et aux règles de l’art. La nouvelle garantie se caractérise par l’objectivité et par sa conformité à l’ordre public.
