المستخلص: كان – ومازال – الوقف رافدا مهما للأمة على المستوى الاجتماعي والاقتصادي والثقافي، وكانت أوقاف المسلمين – ومازالت – تشهد بهذا الإسهام المفيد الذي حض عليه ديننا الحنيف في القرآن والسنة الشريفة وفعل الصحابة الكرام؛ حتى غدا سنة من السنن الحسنة التي سبق بأجرها الأولون، وأولهم رسول الله صلى الله عليه وسلم. ومع هذا الفضل العظيم للوقف تبرز أمامنا بعض الإشكالات الفقهية في التصرف في الوقف وريعه في صور متعددة، ومن أهم تلك الإشكالات: التصرف في ريع الوقف المنقطع الآخر، لما لهذه المسألة من أهمية عظمى؛ لا سيما مع تنامي ريع الأوقاف، وتطور حاجات الناس، مع مراعاة مقصد الواقف عند عدم النص. فجاء هذا البحث منصبا على تحرير قول الفقهاء في هذا المضمار، مع ما اخذ به الأمر السامي الخاص بأحكام الوقف في دولة الكويت؛ ليكون مفيدا لمؤسسات الوقف العاملة بشكل خاص في الكويت؛ كالأمانة العامة للأوقاف، ولسائر البلدان الإسلامية، ومع الأخذ في الاعتبار التطورات الميدانية الحاصلة التي تلقي بظلالها على توجيه ريع الوقف المنقطع الآخر إلى جهة تقتضيها المصلحة والحاجة الآنية. وتميماً للفائدة؛ تطرقت لخلاف الفقهاء في مسائل مهمة ذات صلة تمهيداً لبيان مصرف ريع الوقف عند انقراض عليهم؛ كالنظر في المقصود من قول الفقهاء: (شرط الواقف كنص الشارع)، وحكم تغيير الشرط للمصلحة، وحكم نقل الوقف بنوعيه، مما له وثيق الصلة بالتصرف في ريع الوقف المنقطع الآخر.

The Waqf (endowment) was, and continues to be, an important asset for the nation on the social, economic and cultural level. The Awqaf (endowments) of Muslims was and continues to be a testification to this useful contribution that our true religion encouraged for through the Qur'an, Sunnah and the actions of respected companions of the prophet. They even became a sunnah which was practiced by our ancestors and by the Prophet first of all (May Allah’s peace be upon him). With this great importance of the waqf (endowment), we face in our life some questions of jurisprudence with regards to dealing with the Waqf (endowment) and its ramifications in various forms. One of the most important of these questions is the disposition of the waqf (endowment) because this issue is of great importance, especially the increasing value of the waqf (endowment) and the increasing needs of the people taking into an account the objective of the person who endowed at the time of absence of the text. This research is aimed at highlighting the statement of Islamic scholars in this regard, taking into consideration the special order of the Waqf (endowment) provisions in the State of Kuwait so that it can be useful to the institutions of the Waqf (endowment) working particularly in Kuwait, such as the General Secretariat of Awqaf (endowments) and for the entire Islamic world taking into the account the occurring field developments over the channeling of the proceeds from a suspended waqf (endowment) towards a more important interest or requirement. For the benefit of all, I dealt with the differences of the Islamic scholars about the important and relevant issues in preparation for the statement of the place of spending the value of the waqf (endowment) funds when they are extinct, such as considering the meaning of the statement of Islamic scholars, the ruling on changing the condition for the benefit, the ruling on the transfer of the waqf (endowment) which is closely related to dealing with the value of the waqf (endowment) .
