اقتصرت هذه الدراسة على الآيات التي تحمل دلالة لغوية أو نحوية على حكم شرعي، ولم أتطرق إلى الآيات الأخر التي لم يستنبط منها الفقهاء حكماً بمقتضى قواعد النحو واللغة، وحين أجد في الحكم المُستَنْبط آراء متعددة فإنني لا أذكر إلا ما يستند إلى دليل نحوي أو لغوي, وقد لاحظت أن بعض الفقهاء ينفردون في الاستدلال على حكم الآية بدليل نحوي أو لغوي, في حين لم يستدل الآخرون بهذا الدليل، فأذكر رأي الفقيه القائم على أساس نحوي أو لغوي, دون غيره, وخصصت هذا البحث لبيان أثر دلالة بعض الموضوعات النحوية وهي: (الاستثناء والحال) دون غيرهما من الموضوعات النحوية؛ فالاستثناء ومقتضاه إخراج المستثنى من أن يعُمُه حكم المستثنى منه، وفي ضوء ذلك تخصيص له يميزه عن باقي أفراد المستثنى منه، وقد وردت أحكام شرعية كثيرة مبنيّة على هذا الأسلوب, وليس هذا من قبيل الحصر بل من قبيل الاختصار؛ متمنياً فيما بعد أن يوسع نطاق البحث ليشمل كافة الموضوعات النحوية، للوقوف على دور اللغة العربية الغراء في التقدم والرقي للأمة الإسلامية والعربية، وكل ذلك يبرهن على أن القرآن كان ولا يزال وسيظل خير عون للدارسين والمتخصصين في الأبحاث الفقهية والنحوية واللغوية، فضلاً عن إعانته الباحثين في العلوم الأخرى، فهو كتاب نحوٍ ولغةٍ وتشريع, وإني إذ أضع هذا البحث بين يدي المعنيين بهذا اللون من الدراسة، فإني لأرجو منهم خالص الدعوات في أن يجعلني الله من المخلصين له في كل عمل أبتغيه حتى يؤتي ثماره في النفع لخيري الدنيا والآخرة, سائلاً المولى جلّ جلاله أن يوفقنا لما فيه خير الشريعة ولغتها الغراء.
This study focused on Quranic Verses which have a linguistic or a grammatical significance to legal judgment, and I did not cite in other verses which Muslim jurists did not derive any legal judgment according to the rules of grammar and language. when I find several views in the cited rule I cite only by opinion that. is based on a grammatical or a linguistic evidence. I noticed some Muslim jurists depend on their knowledge on the rule of quranic verse by according to grammatical or linguistic evidence while others did not take this evidence, I cite the opinion of the jurist but I do not cite other opinion which is not based on non-grammatical or linguistic basis. This research is held to demonstrate the effect of some grammatical issues and they are: (The exception and the status) without other grammatical topics; The exception means extracting (the excepted thing) from (the included thing) without being in its rule and in a particular, we distinguished (the excepted thing) from the rest of (the included types). many jurisprudence rules were mentioned which is based on this method. The name but a few , briefly ; Hoping to expand in my research to include all grammatical subjects to determine the role of the Arabic beautiful language in the progress and prosperity of the Islamic Arab nation, all of that prove that the holy Quran is still and will remain as before the best support and the specialists in all fields such as doctrinal, grammatical and linguistic researches as well as It helps researchers in other sciences and It is a book for grammar, language and legislation, I put this research in the handles of specialists who are interested in this kind of this study, I ask them the sincere Supplications that may God makes me be loyal to him in all work which I do to fructify the benefit and the interest for a better world and the best of in the. Hereafter. Asking Allah Almighty to help us all for the good of Islamic legal system and its beautiful language and may Allah-exalted and majestic guide. us all to right path and lead us to success in this life and the after .
