فهذا هو البحث الثالث الذي أواصل فيه دراسة تأثير التأصيل العقدي على المسائل الفقهية، متخذا كتاب الإيمان نموذجاً. فبعد بيان الحدود والتعريفات والتقسيمات العقدية، وكيفية تأثر الفقيه بذلك في أقواله الفقهية على وجه الإجمال في البحث الأول، كان البحث الثاني بداية للدراسة التطبيقية على الفروع الفقهية؛ حيث تناولت المسائل الفقهية المتعلقة بالحلف والحالف. وهذا البحث الثالث هو آخر هذه الدراسة التي جمعت بين الفقه والعقيدة، وأوضحت متانة العلاقة بينهما، وأثر المعتقد على الأقوال الفقهية؛ سأتناول فيه أكثر مسائل كتاب الأيمان الفقهية تعلقا بالعقيدة، وهي المسائل المتعلقة بالمحلوف به، وسأنزل عليها النظرة العقدية التي كان لها الأثر - إما كليا أو جزئيا - في اختلاف أقوال الفقهاء، وقد لا يكون هناك اختلاف، لكني أبرز الجانب العقدي في قول الفقيه وكيفية تناسب القول الفقهي مع هذا الجانب، والدور العلمي الكبير الذي يقدمه علماء العقيدة في بيان وجه قول الفقهاء، والإسهامات العلمية التي أثروا بها العلوم الإسلامية، والتعليلات العقدية التي يذكرونها للقول الفقهي، مما يزيده قوة وبيانا ووضوحا. ولعل أهم ما يميز هذا البحث الأخير هو الإفصاح عن معتقد الفقيه الذي قد لا يكون معروفا على وجه التفصيل من خلال التراجم أو أقواله العقدية أو كلامه العام في مسائل الاعتقاد، فيأتي في الباب الفقهي الذي بناه على معتقده، فيظهر قوله بجلاء.
This is the third research in which I carry on the study of the influence of the creedal rooting on the jurisprudence (Fiqh) issues, while taking the Oath book as a model. Having shown, in the First Topic, the limits, definitions and divisions in the Doctrine, and how the jurist is influenced by that in his jurisprudence (Fiqh) words as a whole, the Second Topic was the start for the applied study on the jurisprudence branches, as it has addressed the doctrinal issues related to the oath and the oath taker. And this is the Third and last Topic of this study, which brought together jurisprudence (Fiqh) and creed, and showed the strength of the relationship between the two, and the impact of the creed on the jurisprudential views. I will consider in it the jurisprudential- oath- matters relating to the doctrine more explicitly, which are the matters related to whom the oath taker is swearing by. In addition, I will project on it the doctrinal outlook that has had an impact – either wholly or in part – in the difference of the scholars’ statements. There may not be a difference, but I will highlight the doctrinal side in the statement of the jurist, and how the jurisprudential view fits with this aspect, as well the great scientific role provided by the scholars of the creed in clarifying the reason in the jurist view, the scientific contributions that have enriched the Islamic sciences, the doctrinal explanations they mention to jurisprudence view that increase its power, detail and clearness. Perhaps the most important characteristic of this last topic is to disclose the (Fiqh) scientist's doctrinal view, which may not be known in detail through the biographies or his doctrinal views or his general words in matters of creed, as he comes in the jurisprudence (Fiqh) perspective, which he has built on his doctrinal belief and therefore reflects his saying clearly.
