المستخلص: شهادة الشاهد الصادقة هي إحدى أساسات أيّ إجراء من الإجراءات الجنائيّة الهادفة إلى إثبات وقائع جريمة مزعومة والتوصّل إلى إدانة المتّهم أو تبرئته. وقد يحتاج الادّعاء العام وجهة الدفاع والممثّلون القانونيّون للمتضررين إلى استدعاء شهود لدعم قضيّتهم. والشهود ملزمون بقول الحقيقة وبالإقرار بأنهم سيقولون الحقيقة قبل الإدلاء بشهادتهم. يُعتَبر وجود نظام فعّال لحماية الشهود من أهم وسائل تضييق الخناق على الفساد وكافة الجرائم والانتهاكات. حيث أنه يوّفر مناخا آمنا ويبث جوا من الثقة يعد ضروريا للتشجيع على الإبلاغ عن كافة أشكال الجرائم. وتعد قدرة الدولة على حماية الشهود من أهم مكونات أي خطة لمكافحة الجريمة بصفة عامة، وجرائم الفساد والإرهاب والجريمة المنظمة بصفة خاصة. تركز هذه الدراسة على توضيح مظاهر الحماية القانونية لأمن الشهود في تشريعات الجزائر والمغرب وتونس

Truthful witness testimony is a cornerstone of any criminal proceeding, which is designed to establish the facts of an alleged crime and the guilt or innocence of an accused person. The prosecution, the defense and legal representatives of victims may all need to call witnesses to support their case. Witnesses are under an obligation to tell the truth and are required to make a solemn declaration that they will do so before they give their testimony. The existence of an effective system of witness protection more resources to take action against corruption and all crimes and violations. As it offers a safe environment and transmits a climate of trust is essential to encourage reporting of all forms of crime. The ability of the state to protect witnesses of the most important elements of any plan against crime in general and corruption crimes, terrorism and organized crime in particular. This study focuses to clarify aspects of legal protection for the security of witnesses in the legislation of Algeria, Morocco and Tunisia.

La véracité d'un témoignage constitue la pierre angulaire de toute procédure criminelle, dont le but est d'établir les faits constitutifs d'une infraction alléguée et de déterminer la culpabilité ou l'innocence d'une personne accusée. Le Procureur, comme la Défense et les représentants légaux des victimes, peuvent avoir besoin d'appeler des témoins pour étayer leur cause. Les témoins ont l'obligation de dire la vérité et doivent s'y engager par une déclaration solennelle avant de témoigner.. Dans l'intérêt de la justice, il peut être nécessaire de protéger certains témoins. L'existence d'un système efficace de protection des témoins des plus importants moyens de sévir contre la corruption et tous les crimes et violations. Comme il offre un environnement sécuritaire et transmet une climat de confiance est essentiel d'encourager le signalement de toutes les formes de crimes. La capacité de l'État à protéger les témoins des éléments les plus importants de tout plan de lutte contre la criminalité dans des crimes généraux et la corruption, le terrorisme et le crime organisé en particulier. Cette étude se concentre pour clarifier certains aspects de la protection juridique pour la sécurité des témoins dans la législation de l'Algérie, le Maroc et la Tunisie.
