|a تأمين المباني من أخطار الكوارث الطبيعية،يعني ضمان تقديم المساعدة المالية التي تسمح للعائلة أو المؤسسة بالاستمرار بالرغم من الخسائر الجسيمة التي لحقت بها جرّاء الكارثة،وهذا ما سعى إليه المقنن الجزائري بالفعل من خلال الأمر رقم 03/12 المؤرخ في 26/08/2003 المتعلق بإلزامية التأمين على الكوارث الطبيعية و بتعويض الضحايا،الذي حاول من خلاله تجسيد فكرة إلزامية تأمين المباني من أخطار الكوارث الطبيعية.وعليه فالتساؤل الذي يطرح في هذا الصدد هو إلى أي مدى نجح المشرع في تجسيد إلزامية التأمين ضذ هذه الكوارث؟.

|b The insurance of buildings against the dangers of naturaldisasters,means the guarantee of a financial assistance thatallows the familyor the instutition to continue in spite of the serious damages caused by thisnaturaldisasters. That is the aim, sought by the algerianlegislator, throught the law n° 12/03, on August 26 th 2003, related to the obligation of insuranceagainst the naturaldisaster and the compensation of the victims ; in a manner to incarnate thisidea. So, the question that arises in thiscontextis : In whatmeasures the legislator has succeeded in making the insuranceagainst the desaster an obligation ?

|d L’assurance des constructions contre les catastrophes naturelles signifie assurer une aide financière qui permettra à la famille ou à l'entreprise de continuer en dépit de lourdes pertes infligées par la catastrophe. Le but recherché par le législateur algérien à travers l’ordonnance n° 03/12 du 26/08/2003 relative à l’obligation d’assurance des catastrophes naturelles et à l’indemnisation des victimes est de rendre obligatoire cette assurance. En conséquence, la question qui se pose à cet égard est dans quelle mesure le législateur a réussi dans sa quête pour rendre obligatoire l'assurance contre les catastrophes?
