المستخلص: الشخص الرقمي هو ممثل للفرد في الوسط الافتراضي. ترتبط نشأته و استمراره بصفة جوهرية بالمعطيات المقدمة و الناتجة عن تفاعله داخل الوسط الافتراضي. غير أن هذا التفاعل لم يكن ليحدث لولا بلوغ تكنولوجيات الويب 2.0 التي أعطت للمستخدم إمكانية اكتساب هوية رقمية و التفاعل وفقها. انطلاقا من عدم التطابق التام و الدائم في عناصر شخصية الفرد و ممثله في العالم الرقمي، تطرح فكرة إمكانية الاعتراف بالشخصية القانوني للشخص الرقمي. اعتراف إن حصل قد يواجه العديد من التحديات القانونية الموضوعية و الإجرائية.

La Personne numérique est un représentant de l'individu dans l’espace virtuel. La création et l’évolution de la personne numérique est basée essentiellement sur les données présentées et produites par l'interaction à l'intérieur de l’espace virtuel. Cependant, cette interaction n’aurait pas pu se produire sans les technologies du Web 2.0, qu’ils ont donné à l'utilisateur la possibilité d'acquérir une identité numérique et d'interagir en conséquence. A partir du manque d'une unité complète et permanente entre l’individu et son représentant dans le monde numérique; elle soulevé l'idée d’une reconnaissance juridique à la personne numérique. Cette reconnaissance - si elle a eu lieu- peut poser de nombreux défis juridiques de fond et de la procédure.

The digital person is representative of the individual in the virtual environment. Its origin and continuity are essentially related to the data provided and resulted of its interaction within the virtual environment. However, this interaction would not have happened without Web 2.0 technologies that gave the user the ability to acquire a digital identity and interact with it. Based on the full and permanent mismatch in the components of individual personality and his representative in the digital world, the idea of recognizing the legal personality of the digital person is raised. This recognition - if it has occurred – can face many law challenges, substantive law and procedure that resulted from his interaction with the virtual environment.

However, this interaction would not have happened had it not been for Web 2.0 technologies that gave the user the ability to acquire and interact with a digital identity. Based on the complete and permanent mismatch in the personality and personality of the individual in the digital world, the notion of recognition of the legal personality of the digital person is raised. Recognition that has occurred may face many substantive and procedural legal challenges.
