المستخلص: Fighting is considered to be a path chosen out of necessity in respect to dealing with others. Muslims could resort to in order to preserve their entity and existence, and to repel various forms of coercion, repression and plots which obstruct their holding on to the guidance of heaven. The Islamic Sharee’ah has set out the goals and objectives that govern fighting. It has established controls, foundations and restrictions which limit bloodshed and prevent spoilage on the ground, in the case damage is repelled as much as possible and at the lowest cost. Based on it, Islamic jurisprudence differentiates between fighters and non-combatants, and it determines who is permissible to kill and who is not permissible to kill.
These pages contain an explanation of the principle of differentiating between combatants and non-combatants based on the definition of combat and its legitimacy and objectives. That is followed by clarifying the principles of fighting as found within Islamic jurisprudence, defining the concept of the principle of differentiating between combatants and non-combatants, and then describing its applications and impact upon life.

يعتبر القتال مسلكا اضطراريا في التعامل، قد يلجأ إليه المسلمون حفظا لكيانهم ووجودهم، ودفعا لشتى أنواع الإكراه والاضطهاد والكيد وما يحول بينهم وبين الاستمساك بهداية السماء. ولقد تولت الشريعة الإسلامية بيان الأهداف والغايات التي تحكم القتال، وضعت الضوابط والأسس والقيود التي تحد من سفك الدماء، وتحول دون الإفساد في الأرض؛ ذلك أن الضرر يدفع بقدر الإمكان وبأقل التكاليف. وتأسيسا عليه فرق الفقه الإسلامي بين المقاتلين وغير المقاتلين، وحدد من يجوز قتله ومن لا يجوز قتله. وفي هذه الصفحات بيان لمبدأ التفريق بين المقاتلين وغير المقاتلين انطلاقا من تعريف القتال وبيان مشروعيته وأهدافه، ثم توضيح مبادئ القتال في الفقه الإسلامي، وتحديد مفهوم مبدأ التفريق بين المقاتلين وغير المقاتلين، ثم بيان تطبيقاته وأثره في الحياة.
