جاءت هذه الدراسة لتســلط الضوء على السياســة الشرعية وفق رؤية متكاملة ووعي للمرحلة، راعت تطورات العصر ومتغيراته في سبيل تحقيق الأمن المجتمعي، وذلك من خلال الفهم الصحيح للنصوص الشرعية؛ لتحقيق الأهداف التي تعمل على تحقيق الأمن المجتمعي من خلال سياســة قائمة على الشريعة الإسلامية. كما بيّنت الدراسة مشروعية السياسة الشرعية، وأهم الأسس والقواعد التي يجب مراعاتها عند تطبيق السياسة الشرعية، ومجالات تطبيقها، حيث تكون في الأمور المباحة في الأصل، ولم يرد نصٌّ شرعي علي تحريمها، كما تكون في النصوص العامة، التي تحتمل الاجتهاد والتأويل، وأبرزت الدراسة أهمية السياسة الشرعية في تحقيق الأمن المجتمعي، من خلال حفظ مصالح الأفراد والجماعات، وأُولاها المصالح الأمنية.
The present study sheds light on legal policy (Al-Siyasah al-Shariya). It treats it as a composite blend of an integrated whole from bi-dimensional considerations vision and its application. The latter should be considered within the broad context of the modern exigencies. In fact, it is imperative to provide ample consideration to the recent development and current variables. Such consideration will ease passage towards eventual and viable community security. Also, it is equally important to gain full comprehension of Sharia textual materials. This is indispensable to realize objectives relative to the attainment of community security. To express in simple words, this is termed as Protection Policy of Islamic Sharia. The present study provides, in candid terms, the legitimacy associated with legal policy (Al-Siyasah al-Shariya). Also, it expounds its various fundamentals and bases that should be considered during the process of its application. Equal consideration should be assigned while applying various areas associated with Al-Siyasah al-Shariya. For, certain issues are Al-mubah (permissible). Some others, on the contrary, are Haram (prohibited). Respective texts exist. The emergent situations necessitate both Al-Ijtihad (institutive judgment) and Al Tawil (interpretation). The present study, therefore, represents an advocacy of applying legal policy (Al-Siyasah al-Shariya) as a sure means of achieving eventual community security. This idealized security will ensure protection of public interests as well.
