تهدف هذه الدراسة إلى بيان الأسباب الحقيقية والخفية وراء رفض إسرائيل تنفيذ ميناء غزة البحري وتسليط الضوء على الذريعة الأمنية التي تستغلها إسرائيل لإجهاض أي اتفاق لا يصب في مصلحتها، والوقوف على أهم الآثار الناجمة عن عدم تنفيذه، وبيان المعايير الدولية التي تحكم الميناء. وتكمن أهمية هذه الدراسة فيما يشكله ميناء غزة البحري من أهمية إستراتيجية واقتصادية وسياسية وقانونية، باعتباره ركيزة أساسية لبناء الدولة الفلسطينية، كما ويسفر عن مدى جدية المجتمع الدولي في انهاء حالة الصراع العربي الإسرائيلي ومدى التزام إسرائيل ببنود اتفاقية أوسلو القانون الدولي العام. وقد خرجت هذه الدراسة بمجموعة من النتائج والتوصيات، إذ يعد ميناء غزة البحري بوابة فعلية وحقيقية للتنمية المستدامة ومعبرا دوليا يدخل في تنمية جميع القطاعات للدولة الفلسطينية كما ويشكل درعا لسلامة أمنها الاجتماعي والاقتصادي والسياسي، ومعيارا حقيقا يبين مدى الهيمنة الإسرائيلية على السيادة الفلسطينية ومفترق طرق ما بين تطبيق العدالة الدولية والممارسات الإسرائيلية. وتوصي الدراسة بضرورة الإسراع بتنفيذ ميناء غزة البحري لتفادي الآثار الناجمة عن عدم تنفيذه، والتي تشمل جميع نواحي الحياة، الاقتصادية والاجتماعية والسياسية وإنهاء حالة المعاناة التي يعيشها أبناء قطاع غزة، ووقف الاستغلال الإسرائيلي الجائر للموارد الطبيعية للدولة الفلسطينية.
This study aims to identify the real and obscured reasons behind Israel’s rejection to implement the Gaza Seaport project and to shine light on the security pretext that the state exploits whenever it is unable take advantage of the situation. The study also explains the most significant consequences in the case that the seaport does not get built and clarifies international standards that govern it. The importance of this study lays in what constitutes the Gaza Seaport of strategic, economic, political, and legal significance. Moreover, it stems from the consideration that it is a fundamental foundation for building the Palestinian state. The end result of the seaport project will exhibit the international community’s standing on ending the Arab Israeli conflict and the extent of Israel’s commitment to the terms of the Oslo agreement and general international laws. The study’s findings and conclusions report that the Gaza Seaport is considered to be a gateway towards sustainable national and international development in all sectors, as well as its providing of social, economic, and political security. It gauges the extent of Israeli hegemony over the Palestinian sovereignty and the crossroad between the application of international justice and Israel’s ongoing practices. The necessity of accelerating the implementation of the Gaza Seaport project will be empphasized. The failure of this project can negatively impact all aspects of everyday life in economic, social, and political terms, whereas its success can mean the end of the constant suffering and torment in the Gaza Strip and the finish of Israel’ increasing exploitation of Palestinian state’s natural resources
