إن تدخل مجلس الأمن في حالات انتهاك قواعد القانون الدولي الإنساني، يتم على أساس تكييفه لوجود حالة تهديد للسلم والأمن الدوليين. وعلى ذلك فإن القرارات التي يتخذها في حال وقوع مثل هذه الانتهاكات، إنما تتخذ استنادا للفصل السابع من الميثاق، وليس عملا بالقانون الدولي الإنساني، فهي تهدف إلى حفظ السلم والأمن الدوليين أو إعادتهما إلى نصابهما. لذا وجب التطرق إلى الأسس التي يستند إليها مجلس الأمن عند تدخله في حالات انتهاك قواعد القانون الدولي الإنساني (المبحث الأول)، وإلى التدابير المتخذة لوقف هذه الانتهاكات ومتابعة المسؤولين عنها (المبحث الثاني). The intervention of the Security Council when the rules of international humanitarian law are violated is based on whether those cases present a threat against international peace and security or not . Therefore, the Council's decisions are taken on the basis of Chapter VII of the United Nations Charter, and not in accordance with the international humanitarian law since they aim at either keeping or restoring international peace or security. In section I, we deal with the bases on which the Security Council intervenes when the rules of international humanitarian law are violated; while section II is about the measures taken to put an end to these violations and to pursuit the guilty parts. Le Conseil de sécurité intervient lorsque les règles du droit international humanitaire sont violées et quand ces violations sont qualifiées de menaces contre la paix et la sécurité internationales. Cela explique pourquoi ses décisions sont prises en vertu du chapitre VII de la Charte des Nations Unies, et non pas en conformité avec le droit international humanitaire car leur objectif consiste à maintenir ou à rétablir la paix et la sécurité dans le monde. Nous traitons dans cet article les bases suivant lesquelles le Conseil de sécurité intervient en cas de violation des règles du droit international humanitaire (Section I), et les mesures prises pour mettre fin à ces violations et poursuivre les coupables (Section II). |
