|a الادعاء المباشر هو إجراء مكتوب موجه لأحد أطارف الخصومة تعلن المحكمة فيه عن ساعة، تاريخ الجلسة، مكانها، الهدف من الحضور ووصف محل النازع. لضمان حقوق الدفاع لأن التكليف إجراء من إجراءات التحقيق بعد رفع الدعوى قضائيا. وقد حصر المشرع الجزائري حالات الادعاء المباشر في خمس حالات، من خلال المادة337من قانون الإجراءات الجزائية الجزائري.
|b The private prosecution is a written procedure to either party in litigation, with which the court of first instance declares the date, time and place of the hearing, thus the aim of presence and description of the claim, to protect the rights of defense because the summon is an investigation procedure after the deposit of the complaint to legal services. The Algerian legislator has limited private prosecution in five cases in the article 337 of the Algerian Criminal Procedure Code.
