إن حظر التعصب الديني بوصفه انتهاكا لحظر التمييز يأتي ضمن الحظر العام للتمييز بغض النظر عن الأساس الذي استند إليه، باعتبار التمييز انتهاكا لحق الإنسان في المساواة، ويأتي إعلان وبرنامج عمل ديربان المعتمدين سنة 2001 والوثيقة الختامية لمؤتمر استعراض ديربان المعتمدة 2009 ليشكلان معا إطاران شاملان وأساسيان متباينان لمكافحة العنصرية والتمييز العنصري وكراهية الأجانب وما يتصل بذلك من تعصب. لقد أقرت المؤسسات الدولية المعنية بحقوق الإنسان أن المادة 4 من اتفاقية القضاء على جميع أشكال التمييز العنصري ليست تلقائية التنفيذ لأنها تلزم الدول الأطراف باعتماد تشريعات لمكافحة خطاب التحريض على الكراهية، وأن الدول ملزمة بحظر خطاب الكراهية بشكل منسق تماما مع احترام حرية التعبير الوارد في المادة 19 فأن ممارسة حرية التعبير تتم مع واجب خاص ومسؤوليات ومع ذلك فالمادة 20 لا تخول حظر الخطاب لمجرد أنه يشير أو يؤدي إلى مخرجات مثل العنف ولكن الصحيح أو الأصح أنها تشمل فئة ضيقة من الخطاب ينحصر بالخطاب الذي يؤسس أو ينشأ دعوة للكراهية على أساس العنصر أو الدين أو الكراهية القومية. إن التسامح لا يعني تقبل الظلم الاجتماعي أو تخلي المرء عن معتقداته أو التهاون بشأنها بل يعني أن المرء حر في التمسك بمعتقداته وأنه يقبل أن يتمسك الآخرون بمعتقداتهم والتسامح يعني الإقرار بأن البشر المختلفين بطبعهم في مظهرهم وأوضاعهم ولغتهم وسلوكهم لهم الحق في العيش بسلام وفي أن يطابق مخبرهم مظهرهم وهي تعني أيضا أن أراء الفرد يعني أن لا تفرض على الغير. وهكذا يدرس هذا البحث وفي مبحثين حظر التعصب الديني بوصفه انتهاك لحظر التمييز في المبحث الأول، وحظر التعصب الديني بوصفه انتهاك لحظر الكراهية في المبحث الثاني.
