تعد مواضيع حقوق الإنسان من بين أهم المواضيع التي تشغل الرأي العام الدولي والداخلي، فقد سعى المجتمع الدولي منذ الإعلان العالمي لحقوق الإنسان لاحترام وتنفيذ وحماية هذه الحقوق، وقد عرفت هذه الحقوق امتدادا منذ سبعينيات القرن الماضي لاسيما بظهور مفاهيم جديدة كمفهوم حماية البيئة والتنمية المستدامة، لتظهر معها طائفة جديدة من حقوق الإنسان عرفت بحقوق الإنسان الجيل الثالث، تشمل حق الإنسان في التنمية، وحقه في التراث المشترك، وحقه في بيئة صحية وسليمة، إلا أن هذه الحقوق الجديدة لاسيما حق الإنسان في بيئة صحية وسليمة قد أحاط بها جدل واسع حول طبيعتها وقيمتها القانونية، فهل هي مجرد مبادئ عامة، أم هي مبادئ أخلاقية تلتزم بها الدول بإرادتها الاختيارية، أم هي حقوق أساسية للإنسان معترف بها دوليا وداخليا، تستوجب احترامها، وتنفيذها، وحمايتها، وتعزيزها، دوليا وداخليا، كل هذا يستلزم البحث والتحليل لمختلف جوانب هذا الموضوع لفهم طبيعة وقيمة وآثار الاعتراف بحق الإنسان في البيئة كحق من حقوق الجيل الثالث. Les sujets des droits de l'homme sont parmi les sujets les plus importants qui préoccupent l'opinion publique interne et internationale, la communauté international à chercher depuis la Déclaration universelle des droits de l'homme à respecter et à mettre en œuvre la protection de ces droits, qui ont connu une extension depuis les années soixante-dix du siècle dernier, en particulier l'émergence de nouveaux concepts comme le concept de protection de l'environnement et du développement durable, se présenter avec une nouvelle gamme de droits de l'homme connu sous le nom de la troisième génération des droits de l'homme, y compris le droit au développement, le droit à l'héritage commun, et le droit à un environnement sain et sécuritaire. Cependant, ces nouveaux droits, en particulier le droit de l'homme à un environnement sain et sécuritaire avaient pris une large controversée sur sa nature et sa valeur juridique, sont-ils des simples principes généraux ?, des principes morals pris l’obligation par les nations avec une volantée de choisir, ou bien sont- ils des droits fondamentaux de l'être humain reconnus au niveau national et internationale ?, qui exiges, les respectés, les appliqués, les protégés et de les promouvoir, à l'échelle national et international, tout cela nécessite la recherche et l'analyse des différents aspects de ce sujet pour comprendre la nature et la valeur et les effets de la reconnaissance du droit humain à l'environnement en tant que droit de l'homme de troisième génération. Human rights are among the most important issues of concern to international and domestic public opinion. Since the Universal Declaration of Human Rights, the international community has sought to respect, implement and protect these rights. These rights have been recognized since the 1970s, especially with the emergence of new concepts such as environmental protection and sustainable development, bringing together a new range of human rights known as third-generation human rights, including the right to development, the right to common heritage, and the right to a healthy and healthy environment. However, these new rights, particularly the human right to a safe and healthy environment, have been widely debated over their nature and legal value. Are they just general principles, or are they ethical principles to which States are bound by their own voluntary will, or are they fundamental human rights that are internationally and internally recognized, which must be respected, implementated, protected and promoted, both internationally and internally. All of this require research and analysis of the various aspects of this topic so as to understand the nature, value and implications of recognizing the human rights to the environment as a third-generation right.
