المستخلص: نظرا للانتقادات الموجهة للمجالس الدستورية التي تضمّنها دستور سنة 1989 وكذا تعديله سنة 1996، سعى المؤسس الدستوري لسنة 2016 إلى تفادي هذه الانتقادات وسدّ الفراغ الذي شاب الدساتير السابقة في مجال الرقابة الدستورية، سواء من حيث تغيير تشكيلته وتحديد شروط عضويته وضمان استقلاليته واستقلالية أعضائه، أم من حيث توسيع جهات الإخطار إلى كل من الوزير الأول، والمعارضة البرلمانية وحتى الأفراد عن طريق آلية الدفع بعدم الدستورية، كما عمل على دسترة الطابع النهائي لآراء وقرارات المجلس وإعطائها القوة الإلزامية، وهذا كلّه سيؤدي إلى تفعيل دور المجلس الدستوري الذي كان ينحصر عمله في الرقابة الإلزامية والرقابة في مجال الانتخابات، أمام محدودية آلية الإخطار التي تعود أساسا إلى أسباب سياسية، كما أن هذا قد يؤدي إلى إرساء الديمقراطية التعددية خاصة فيما يتعلق بدسترة حقوق المعارضة وإلى بناء دولة القانون.

Due to the criticisms of the Constitutional Councils contained in the 1989 Constitution and its 1996 amendment, the Constitutional Founder of 2016 sought to avoid such criticisms and fill the void in previous Constitutions in the field of constitutional control, both in terms of changing its composition, determining the conditions of its membership and To ensure its independence and the independence of its members, or in terms of expanding the notification bodies to both the Prime Minister, the parliamentary opposition and even individuals through the mechanism of invoking unconstitutionality. It also worked to legitimize the final nature of the opinions and decisions of the Council and give it mandatory force. All this will lead to the activation of the role of the Constitutional Council, whose work was limited to mandatory monitoring and election monitoring, given the limited notification mechanism, which is mainly for political reasons. This may also lead to the establishment of pluralistic democracy, particularly with regards to the consolidation of the rights of the opposition and building the rule of law.
