يهدف البحث إلى الكشف عن الحالات التي تتسامح فيها الشريعة في إيجازة التوابع والضمنيات، أو إيجازة الدوام والبقاء، أو إيجازة الابتداء، أو الوسائل المحرمة قصدا، الجائزة ضمنا، بصفتها طريقا إلى مقصد مطلوب من الشرع تكليفا، ومن المكلف تحصيلا، متطرقا بالدراسة والتحليل لمفهوم الإغتفار، وأسبابه، وجامعا لقواعده، كاشفا عن أدلتها، وموضحا شروط إعمالها، ومجليا تطبيقاتها، ومبرزا لأمثلتها، ومفصلا في أنواعها، ومشيرا إلى الضوابط ذات الصلة بها، ومبينا أهم النقاط الأساسية التي تمس الحاجة إليها في معرفة أبعاد الموضوع الذي نحن بصدده، لكي يتأتى التخريج في القضايا المستجدة، مجيبا عن تساؤلات واردة في مشكلة البحث، هي : متى يجاز العمل المحرم شرعا، وما هي الصفة التي يجاز عليها ؟ وما ضابط ذلك الجواز؟ وما أسبابه ؟ وقد اتبعت المنهج الوصفي في البحث، وذلك من خلال استقراء آراء الأصوليين والفقهاء مع عرض أدلة أقوالهم. وكذلك المنهج التحليلي القائم على البيان والتفسير، ثم التحليل والاستنباط، وصولا إلى ما رام البحث الانتهاء إليه. وقد توصلت إلى جملة من النتائج، أهمها: أن قواعد الإغتفار تحقق مقاصد الشرع في العدل، والرفق بالخلق، والتيسير عليهم، ورفع الحرج عنهم، في الأحكام التي يتلبس المكلفون بها عن جهل ونحوه ثم يعسر الانتزاع منها، وأن قواعد التبعية والدوام والابتداء، ألفاظ وصيغ متعددة، وقد تبين من خلال البحث أن هذه الصيغ وإن اختلفت في اللفظ لكنها متفقة على المعنى المراد في هذا المقام. ومن أهم توصيات البحث : إجراء دراسات أخرى في تأصيل قواعد الاغتفار وبيان علاقتها بأصول الفقه وصلتها بأدلة التشريع وقواعده، وكذلك في قواعد الاغتفار وضوابطه ودورها في حفظ الضرورات الخمس.
This research study aims to investigate the cases where the Sharia tolerates the permissibility of the dependence or the permissibility of the permanence and the survival, or the starting or even the in¬tentionally forbidden means and the implicit permissibility as being a required means to the desired goal of the law and as an achieve¬ment for all. The researcher of this study examined and analyzed the concept of absolving or forgiveness and its reasons, incorporating its rules, revealing its indications, clarifying its conditions, uncovering its practices, showing its examples, detailing its different types, indi¬cating its relative regulations, and exploring the most important key points that are urgently needed to know the dimensions of the topic of this study. To achieve all the above mentioned objectives, the re¬searcher raised some questions set forth in the problem statement of the study, foremost of which are: when a forbidden act is legally permissible? And in what way? What regulates such permissibility? And what are the reasons behind that? In this study, the researcher adopted an analytical descriptive method through extrapolating of the views of fundamentalists and scholars with giving some evi¬dence of their views. The researcher has come up with a conclusion that the rules concerning forgiveness realizes the purposes of the Islamic law in justice, kindness to all mankind and easing and reliev¬ing them from whatever rules which they overtake either by igno¬rance or otherwise, as well as overcome the difficulties that encoun¬ter them. The rules of Dependence and Permanence and Initializa¬tion are numerous forms and even these forms are verbally different but have one meaning in this regard. This study has come up with certain recommendations that further studies in the forgiveness rules should be conducted. The nature of the relationships of these rules with the jurisprudence foundations (Fiqh) and its relevance to the evidence of legislation and its rules should also be investigated. In addition, the rules and regulations of forgiveness and its role in preserving the five imperatives in Islam should be explored.
