المستخلص: ذكر الشاطبي في خاتمة الجزء المتعلق بالمقاصد من كتابه الموافقات أربعا من الجهات التي يعرف بها ما هو مقصود للشارع مما ليس بمقصود له، وذكر محمد الطاهر بن عاشور ثلاثة من الطرق التي يتوصل بها إلى إثبات المقاصد الشرعية، وهي مختلفة عما ذكره الشاطبي. وقد أورد بعض المعاصرين إشكالات على بعض تلك الجهات، كما استشكلوا الاختلاف الواقع بين الشاطبي وابن عاشور. وقد انعكست تلك الإشكالات على الطرق التي صاغها بعض الكتاب المعاصرين للتعرف على مقاصد الشريعة فصارت هي -أيضا -محل استشكال. وهذا البحث يهدف إلى الإجابة عن الإشكالات التي أثيرت حول ما ذكره الشاطبي وابن عاشور، كما يهدف إلى صياغة جديدة للطرق التي تعرف بها المقاصد؛ بناء على انقسام المقاصد إلى مقاصد الخطاب الشرعي، ومقاصد الأحكام الشرعية. ويقوم منهج البحث على عرض ما ذكره الشاطبي وما أورده عليه المعاصرون من استشكالات، مع تحليل ومناقشة تلك الاستشكالات، ثم عرض ما ذكره ابن عاشور وما أورده عليه المعاصرون من استشكالات مع تحليل ونقد لها، ثم عرض أهم الطرق التي ذكرها المعاصرون مع التحليل والنقد، وفي الختام تقديم صياغة جديدة للطرق التي تعرف بها المقاصد. وقد خلص البحث إلى سلامة ما ذكره كل من الشاطبي وابن عاشور وعدم تعارضهما؛ على الرغم مما بينهما من اختلاف، وأن سبب ذلك الاختلاف يرجع إلى اختلاف نوع المقاصد التي يراد التعرف عليها. كما خلص البحث إلى أن سبب نقد المسالك التي ذكرها الشاطبي يعود إلى عدم فهم مراده، وأن الغموض السائد في الكتابات المعاصرة يعود إلى عدم التفريق بين مقاصد الخطاب الشرعي ومقاصد الأحكام الشرعية، وعدم إدراك أن لكل واحد منهما مسالكه التي يكشف بها عنه.

Shatbi mentioned in the conclusion of the section related to the purposes of his book Almuwafaqaat four directions that is known to be intended by the legislator from what is not intended by him. Muhammad al-Tahir bin Ashour mentioned three ways to prove the purposes of Sharia, which is different from what is mentioned by Shatbi. Some contemporary scholars have brought up questions on some of these directions, and they have also questioned the difference between Shatbi and Ibn Ashour. These problems have been reflected in the methods formulated by some contemporary writers to identify the purposes of the Shari'a, and they have also been questioned. This research aims to answer the problems raised about what is mentioned by Shatbi and Ibn Ashour. It also aims to formulate new ways to identify the purposes; based on the division of the purposes into the purposes of the message of Sharia, and the purposes of its provisions. The methodology of the research is that it firstly presented what Shatbi mentioned and the questions brought up by the contemporary writers, with analysis and discussion of these questions, then it presented what Ibn Ashour mentioned and the questions brought up by the contemporary writers with analysis and criticism, and then presented the most important methods mentioned by contemporary writers with analysis and criticism, and at the end introduced formulation of new ways to identify the purposes. The research concluded in correctness of what both Shatbi and Ibn Ashour have said and that they do not contradict, despite the difference between them and that the reason for that difference was due to the different type of purposes that was meant to be identified. The research also concluded that the reason for criticizing the tracts mentioned by Shatbi is due to lack of understanding of his intention and that the ambiguity prevailing in contemporary writings is due to the lack of differentiation between the purposes of the message of Sharia and the purposes of its ordinances, and not realizing that each of them has its own ways of revealing it.
