المستخلص: فهم النصوص في ضوء المقاصد يقصد به: إدراك ما تضمنته النصوص من أحكام دلت عليها ظواهر الألفاظ ومقاصد الأحكام، فكل ذلك مراد للشارع فكما يؤخذ الحكم من ظاهر اللفظ يؤخذ من معناه ومقصده، ولا يجوز أن تهمل ظواهر الألفاظ بدعوى الاكتفاء بالمعاني والمقاصد، ولا أن تهمل المعاني المتضمنة في النصوص جمودا على ظاهر اللفظ؛ لأن في هذا إهدارا لمقاصد الشارع فيما أنزله من أحكام دل عليها بالمعاني المتضمنة في النصوص. وقد دل على وجوب مراعاة المقاصد: القرآن الكريم، والسنة النبوية، وعمل الصحابة، حيث كانوا ينظرون إلى النصوص وإلى مقاصدها وعللها، وقد أقرهم الرسول صلى الله عليه وسلم على ذلك. والمقاصد التي يجب مراعاتها في فهم النصوص: هي التي يتم استخراجها من دلالات النصوص وعللها، وليست المقاصد أمورا يتخيلها الناس ثم يفرضونها على الشريعة من خارجها كما يريد بعض العلمانيين في محاولتهم تجاوز الشريعة ونصوصها بمقاصد تبتدعها أنفسهم. ومراعاة المقاصد في فهم النصوص ينتج عنها توسيع لدلالة النص أو تضييق تلك الدلالة بحسب ما يوجه به المقصد الذي أنيط به الحكم الوارد في النص، كما أن لمراعاة المقاصد أثرا في حسن تطبيق الأحكام وتنزيلها على الوقائع التي هي محل لتلك الأحكام وقد أوردت الكثير من الأمثلة التي توضح هذا الأثر.

Understanding texts in the light of the purposes means: to understand the provisions contained in the texts, which are indicated by the phenomena of words and the purposes of the rulings, all of this is meant by the legislator as it is taken from the appearance of the word, so is taken from its meaning and purpose. It is not permissible to neglect the phenomena of words claiming to be satisfied with meanings and purposes. Phenomena of words cannot be neglected claiming that meanings and purposes are enough, nor the meaning contained in the texts, sticking to the appearance of the word, because it violates the purposes of the lawgiver in the ordinance he revealed, implied by the meaning contained in the texts. What indicated that the purposes must be considered is: the Holy Quran, Sunnah, and the practices of the companions, as they looked at texts its purposes and pretexts as they avowed to the Prophet (peace and blessings of Allah be upon him) on that. The purposes that must be considered in the understanding of texts are the ones extracted from the meanings of the texts and their pretexts. The purposes are not those things that people imagine then impose on Sharia from the outside, as some secularists want in their attempt to transcend Sharia and its texts with their own invented purposes. Consideration of purposes in understanding the texts expands the meaning of the text or narrows that meaning as directed by the intention mandated by the ruling set out in the text. Consideration of the purposes also has an impact on the proper application of the rulings and its application on the events which are subject to them. I gave and many examples to illustrate this effect.
