إن لكل نص من النصوص الشرعية والقانونية روحا ومقصدا وضع لآجله هذا النص، فالنصوص شرعت لحماية مصلحة معينة يتوخاها المشرع، وحتى يتم تطبيق النصوص على النحو الأمثل لا بد من فهمها فهما سليما، وإن من أهم طرق فهم النصوص فهمها في ضوء المقاصد والمصالح، ومن هذا المنطلق تناول الباحث هذا الموضوع تحت عنوان:(فهم النصوص دراسة مقاصدية). واتبع الباحث في بحثه المنهج الوصفي التحليلي، وتحدث في بدايته عن التعريف المقاصدي للنصوص، ثم تناول الحديث عن أهمية فهم النصوص بالنسبة للمجتهد والمفسر والقاضي والمشرع، كما بين الضوابط التي تحكم عملية فهم النصوص، ثم تناول الحديث عن طرق فهم النصوص الشرعية القانونية، ووضح بالشرح والتمثيل مسألة فهم نصوص الشرعية والقانونية في ضوء المقاصد، وختم الباحث بحثه بخاتمة لخص فيها النتائج والتوصيات.

From this Perspective, the researcher dealt this issue under title “Understanding the Texts, Use wit to reach purposes”. In his research, the researcher followed descriptive and analytical method. At the beginning of the search, he talked about definition of texts in terms Of purpose. Then he dealt with the importance of texts understanding by the diligent person, the who explains it, the judge and the legislator. He also dealt with the purposes that govern the process of understanding the texts. After that, he talked about ways of legal and shariah texts understanding, he Illustrated this by explaining and representing the issue of legal and shariah Texts understanding in the light of the purposes. The researcher has come up with some conclusions and recommendations.
