المستخلص: تسعى هذه الدراسة إلى بيان المراد بالاجتهاد التحقيقي (فقه التطبيق) عند الأصوليين، وبيان المعالم والأسس لهذا النوع من الاجتهاد، بمنهجية وصفية استنباطية تحليلية. فهي تحاول أن تجيب عن إشكال الصلة بين التطبيق والامتثال ومقاصد الشريعة والتكليف والمكلفين، وعن تكييف النسب الاقتضائية التبعية الإضافية الكامنة في النوازل والوقائع والمستجدات، مع مراعاة الاقتضاءات الأصيلة للخطاب وعموم هيمنة الشريعة على أفعال المكلفين. كما حاولت الدراسة طرح إشكال الثبات والتغير من خلال فقه معالم التطبيق واختصاصات التنفيذ، فأدلت فيها ببيان وإفادة.

This study seeks to clarify the meaning of Investigative extrapolation (the jurisprudence of application) in the view of Scholars of Usool (fundamentals of Fiqh), and to describe the characteristics and base of this type of Ijtihad (extrapolation) with an analytical descriptive methodology. It tries to answer the question of the relationship between application and compliance and the purposes of the Shari'a, the obligation and the person who is obligated. And about the adaptation of the additional dependent required relationship inherent in comtemporary times and the reality and developments, taking into account the original requirements of the discourse and the general hegemony of Shari'a on the actions of the person who is obligated. The study also tried to raise the issue of stability and change through the jurisprudence of application and implementation terms, and made an explanation and a statement.
