|b This study addresses one of the custom study's partials in the assets of Islamic jurisprudence, which is partial of the interest reasoning by custom activation Specifically in al shafi'i school. This study aimed at discern the true position of Al Shafi'i school of custom, and the extent of use this curricula as one of the interests diligence. and in order to achieve its purposes, The study followed the inductive approach, analytical, and has pursued a comparison method. In order to achieve its goal the study has treated several axes, which had been Represented in showing the fact of the meaning of interests reasoning first, and then in looking at the meaning of custom which the study has sought to demonstrate this curricula features in al Shafi'i school, and its relationship with interests reasoning. The study then started in showing these features in the doctrine, through the search in areas in which al Shafi'i school activated the custom in, and the statement of trends within the doctrine in the activation of those fields whenever the need arises, come up with doctrinal applications on each of those fields, and in order to complete the requirements of research In the theoretical and applied sides. Moreover, the study has reported the conditions that considered in the school during the realization of the custom. The study concluded after those detectives that al Shafi'i school depends on the interests diligent through the custom approach, and that this approach of curriculum has many fields depending on the unrestricted interests mainly to it, and that there are conditions for the adoption of the custom in the doctrine which governing the process of interests reasoning that based on the custom, and making its activation doomed by the legitimate text , appropriate for its purposes.

|a تتناول هذه الدراسة جزئية من جزئيات مبحث العرف في أصول الفقه الإسلامي، هي جزئية الاجتهاد المصلحي من خلال منهج إعمال العرف في المذهب الشافعي تحديدا. وتهدف هذه الدراسة إلى تبين حقيقة موقف المذهب الشافعي من العرف، ومدى استعماله منهجا من مناهج الاجتهاد المصلحي، وانتهجت الدراسة في سبيل ذلك المنهج الاستقرائي والتحليلي، وكذا المنهج المقارن. وقد تطرقت الدراسة في سبيل ذلك إلى المحاور المتمثلة في بحث معني الاجتهاد المصلحي أولا، ثم في بحث معني العرف الذي تصدت الدراسة لبيان معالمه في المذهب الشافعي، وعلاقته بالاجتهاد المصلحي. ثم بدأت الدراسة في تبين هذه المعالم في المذهب من خلال بحث المجالات التي أعمل المذهب الشافعي العرف فيها، وبيان الاتجاهات داخل المذهب في إعمال تلك المجالات كلما دعت الحاجة إلى ذلك، مع إيراد تطبيقات فقهية لكل مجال من تلك المجالات، وذلك في سبيل استكمال متطلبات البحث في جانبية النظري، والتطبيقي. ثم أن الدراسة قد أوردت الشروط التي اعتبرها المذهب إبان إعماله للعرف. وقد خلصت الدراسة بعد تلك المباحث إلى أن المذهب الشافعي يجتهد اجتهادا مصلحيا من خلال منهج إعمال العرف، وأن لهذا المنهج من مناهج الاجتهاد المصلحي مجالات عديدة تعتمد المصلحة المرسلة أساسا لها، وأن لإعمال العرف شروطاً في المذهب تحكم عملية الاجتهاد المصلحي بناء عليها، وتجعل إعماله محكوماً بالنص الشرعي، وملائما لمقاصده .
