المستخلص: انطلاقا من حق الأفراد في الانتقال المكفول في المواثيق الدولية والتشريعات الداخلية، وانطلاقا من حق الدولة في بسط قوانينها على اقليمها ومنع كل من لا ترغب في الدخول لها، اهتمت المجموعة الدولية الاقليمية والوطنية في البحث عـن حلـول جوهرية، تحقق توازن الطموح والمصالح في ظل احترام الحقوق والحريات. على هذا الأساس، يحاول هذا المقال توضيح الآليات المتخذة لمعالجة الهجرة غير الشرعية، ومدى فعالية هذه الآليات في احترام الحريات والحقوق الإنسانية، سواء بالنسبة للجزائر أو بالنسبة لجوارها الاقليمي (خاصة الجوار العربي ـ الأوربي).

On the basis of the individuals’ right to relocate that is guaranteed in the international conventions and the national legislations, and based on the right of the state to extend and spread its laws on its territory and to prevent all those whom it does not wish to enter into it. The international, regional and national community focused on the search for fundamental solutions which achieve a balance of the ambition and the interests, while respecting the human rights and freedoms. On this basis, this article attempts to clarify the mechanisms adopted to tackle the illegal immigration, and the effectiveness of these mechanisms in respecting freedoms and human rights, either for Algeria or for its regional vicinities (particularly the euro-Arab vicinity).

Partant du droit des individus de se déplacer d'un endroit à un autre garantis dans les conventions internationales et la legislation nationale, sur la base du droit de l'état d'etendre ses lois sur son territoire et d'empecher tous ceux qui ne souhaitent pas entrer en elle, axee sur la communaute internationale, regionale et nationale dans la recherche de solutions fondamentales, verifier l'equilibre de l'ambition et les intérêts , tout en respectant les droits et des libertes de l'homme. Sur cette base, cet article tente de clarifier les mecanismes prises pour lutter contre l'immigration illegale (l'immigration clandestine), et l' efficacité de ces mécanismes dans le respect des libertes et des droits de l'homme, a la fois pour l'algerie ou pour l' oceanographiques regionaux (euroarabe)
