المستخلص: يعتبر السكن الشغل الشاغل للمواطن في هذا الوقت، لدا نجد أن الحكومة تبدل مجهودات كبيرة لمواجهة هذا المشكل نظرا لتزايد الإحتجاجات ووجود عجز كبير في الميدان، لدا فإن وزارة السكن كممثل للدولة أوجدت العديد من الصيغ وأعلنت فـي الست (6) سنوات الماضية أنها ستوفر حوالي مليون سكن بكافة الصيغ، وأمام هذا العدد الضخم من السكنات التي ستنجز فـيظرف قياسي، فإنه سيكون لزاما تشديد الرقابة على أعمال البناء ومن تم تحديد مسؤولية كل الأطراف المتدخلة في عملية توفير تلك السكنات، وما يهمنا في هذا البحث هو مسؤولية المرقي، المقاول والمهندس المعماري وكل متدخل في عملية البناء، وهذا يجرنا إلى طرح الإشكالية التالية: ما مدى فاعلية النظام القانوني لمسؤولية المتدخلين في البناء ؟ . وقد أجبنا عن هذه الإشكالية ووصلنا أن هذا النظام القانوني ما يزال عاجرزا عن حماية المالكين.

The housing is the main concern of the citizens at this time. Thus, the government has launched great effort to face this problem due to the increasing of protests and the large deficit in the field. So, the Ministry of housing as ,a representative of the state, has created many formats and announced that in the six (6) years past it will provide about one million houses using all the formulas. And in front of this huge need for houses that will be completed in record time number, it will have to tighten the control over the construction work and who have been determining the responsibility of all intervening parties in the process of providing those needs. What concerns us in this research is the responsibility of promoters, the contractor and the architect and all intervening in the construction process, and this leads us to ask the following problem: What is the effectiveness of this system to rule the participants in the construction? We have had this probleme and we got that this system is still weak to protect the owners.

Le logement est la principale préoccupation des citoyens à ce moment. Ainsi, le gouvernement a lancé un grand effort pour faire face à ce problème en raison de l'augmentation des protestations et l'important déficit dans le domaine. Ainsi, le Ministère du logement comme, un représentant de l'Etat, a créé de nombreux formats et a annoncé que, dans les six (6) ans passé, il fournira environ un million de maisons à l'aide de toutes les formules. Et en face de cette énorme besoin de maisons qui seront achevés au nombre record de temps, il devra renforcer le contrôle sur le travail de construction et qui ont été de déterminer la responsabilité de toutes les parties intervenant dans le processus de prestation de ces besoins. Ce qui nous intéresse dans cette recherche est de la responsabilité des promoteurs, l'entrepreneur et l'architecte et tout intervenant dans le processus de construction, ce qui nous amène à poser le problème suivant: Quelle est l'efficacité de ce système pour gouverner les participants dans la construction? Nous avons eu ce problèmes et nous avons obtenu que ce système est encore faible pour protéger les propriétaires.
