|a تأتي منظومة الحقوق الأساسية كآلية ثانية لتجسيد مبادئ حقوق الانسان داخل النظام القانوني الداخلي. وأهم هذه الحقوق الحق في المساواة. الذي نصت على احترامه جميع المواثيق الدولية للحقوق، وهذا لأهميته في استقرار وديمومة الأنظمة السياسية. لذا لجأت الدساتير الحديثة الى التأسيس لمبدأ المساواة لضمان احترامه من قبل جميع المؤسسات والإدارات العمومية، بل حتى من طرف منتجي النصوص القانونية عند سنهم لتلك النصوص. وفي هذا الإطار، أنشأ المؤسس الدستوري الجزائري المجلس الدستوري، كجهاز مكلف بالسهر على احترام الدستور، من خلال رقابته للدستورية، وقد راعى المجلس في آرائه وقراراته احترام النصوص القانونية لمبدأ المساواة، بل الأبعد من هذا، استند المجلس الدستوري لهذا المبدأ في حمايته للعديد من الحقوق الأساسية ضد مساس المشرع بها، ومن هنا تبرز أهمية الحماية الدستورية لهذا المبدأ.

|b Fundamental rights is the second mechanism for the realization of the principles of human Rights in the domestic legal system. The most important of these rights is the right to equality. Which he devotes all international conventions on human rights for its importance in the preservation of human dignity and the stability of political systems. So modern constitutions have made the principle of equality to ensure compliance by all the institutions and governments, even by the legal texts producers when their creation to these texts. In this context, the Algerian constitution established the Constitutional Council to ensure respect for the Constitution, through its control of constitutionality. the Council took into account in its case law the respect of the legal texts of the principle of equality, but further from this, the Constitutional Council was based on this principle in the protection of many fundamental rights against the legislature itself, hence the importance of the constitutional protection of this principle.

|d Les droits fondamentaux est le deuxième mécanisme pour la réalisation des principes des droits de l'homme Dans le système juridique interne. Le plus important de ces droits est le droit à l'égalité. Qui il a consacré par tous les conventions internationales des droits de l'homme pour son importance dans la préservation de la dignité humaine et la stabilité des systèmes politiques. Donc constitutions modernes ont constitués le principe d'égalité pour assurer le respect par toutes les institutions et les administrations publiques, même par les producteurs de textes juridiques lorsque leur création à ces textes. Dans ce contexte, la constitution algérien a établi le Conseil constitutionnel, pour assure le respect de la Constitution, par son contrôle de la constitutionnalité. Le Conseil a pris en compte dans son jurisprudence le respect des textes juridiques du principe de l'égalité, mais plus éloigné de cela, le Conseil constitutionnel a été basée sur ce principe dans la protection de nombreux droits fondamentaux, contre le législateur lui-même, d'où l'importance de la protection constitutionnelle de ce principe.
