|a يرتبط مبدأ استقلالية القضاء ارتباطا وثيقا بدولة القانون التي تقوم بدورها على ركيزة أساسية وجوهرية هي مبدأ الفصل بين السلطات، هذا المبدأ الذي يضمن عدم تعدي أي سلطة على أخرى.\nكرست الدساتير المغاربية مبدأ استقلالية القضاء وأحاطته بمجموعة من الضمانات القانونية التي تكفل تجسيده تجسيدا عمليا، إلا أن ذلك يبقى غير كاف كون مفهوم استقلالية القضاء شهد تطورا جذريا، إذ أصبح يقاس بمدى قدرة القضاء على إنتاج القواعد القانونية.\nوعلى هذا الأساس يبقى طلب التحرك الجدي والحقيقي قائما لفتح المجال أمام السلطة القضائية للمساهمة في العمل التشريعي، بحيث تكون مساوية للسلطتين التشريعية والتنفيذية دون تبعيتها لإحداهما.
