المستخلص: This study discusses the topic of “relief” due to the fear of losing the company while travelling, its impact on Islamic jurisprudence and its contemporary applications.
Various branches of Islamic jurisprudences have been the subject of studies in which the “relief” topic was discussed, as is evident in the matter of “tayammum” without requesting for water because of losing the company of co-travellers and similarly the permission for praying while onboard a vehicle, or leaving the prayers behind Imam if continuing prayers under the leadership of Imam could cause losing the companionship and the consent for travelling on Friday at the prayer (congregation prayer) time if the caravan was to leave at that very moment.
The topic of “relief” has also been discussed in the provisions of Hajj. To enter into Ihram is conditioned with the existence of travel companionship, and not-returning of one who has passed the “Meeqaat” without entering ihram for the “meeqaat”, fearing that he will miss the company and the possibility of tawaf of menstruating woman for “tawaful ifada” and dropping the necessity of “farewell tawaf” or staying night at “dil halifa” for the one returned to Medinah from Makkah as performer of Hajj or Umrah due to fear of losing company.
The study dealt with various types of matters. The issue of eating “haram” food when it is not possible to get “halal” food for fear of missing company, and the ruling on the women who is in here “iddah” period and whose husband dies after entering “ihram” for Hajj, and giving priority to the traveller on the resident when dissolving disputes before the judge and there is the fear that he may lose the travelling companionship.
The researcher reached several conclusions, the most important of which is that "relief" due to the fear of missing travel companionship is mentioned in the jurisprudence of the four schools of fiqh, as well as in the school of "Zahiriyah" and has a distinguished place in the school of Shaafa'i and Hanbali.
There is scope for applying this "relief" factor due to the fear of missing travel companionship to contemporary realities, especially in the field of collective and organised travel by modern means of transportation such as aircraft, ships, trains, buses, etc.

يتناول هذا البحث بالدراسة القول بالتخفيف بسبب خوف فوت رفقة السفر، وأثر ذلك في الفقه الإسلامي وتطبيقاته المعاصرة .
فقد تمت دراسة عدد من الفروع الفقهية التي ظهر فيها القول بالتخفيف، حيث ظهر في مسالة التيمم دون طلب الماء عند خوف فوت الرفقة، وكذلك جواز صلاة الفريضة راكبا في الحافلة، خوفا من فوت الرفقة، وإمكانية مفارقة المأموم لإمامه إذا كانت متابعة الإمام تتسبب في فوت رفقة السفر، وجواز السفر يوم الجمعة وقت صلاة الجمعة إذا كانت القافلة ستغادر وقت الصلاة .
كما ظهر القول بالتخفيف في عدد من مسائل الحج، فاشترط للإحرام بالحج وجود رفقة للسفر معهم، وعدم عودة من جاوز الميقات دون إحرام للميقات، خوفا من فوت الرفقة، وإمكانية طواف الحائض لطواف الإفاضة، خوفا من فوت الرفقة، وسقوط طواف الوداع بسبب خوف فوت الرفقة، وسقوط المبيت بالمعرس في ذي الحليفة لمن عاد إلى المدينة من مكة حاجا أو معتمرا عند خوف فوت الرفقة.
وتطرق البحث لعدد من المسائل المتنوعة، فتناول مسألة الأكل من الطعام المحرم عند تعذر طلب الحلول، خوفا من فوت الرفقة، وحكم عدة المرأة التي يموت زوجها بعد إحرامها بالحج، وتقديم المسافر على المقيم عند فصل الخصومات أمام القاضي عند خوف فوت رفقة السفر.
وقد توصل الباحث إلى عدة نتائج، من أهمها أن التخفيف بسبب خوف فوت رفقة السفر ورد في فقه المذاهب الفقهية الأربعة، وكذلك عند الظاهرية بشكل واضح وتميز به الشافعية والحنابلة.
وأن هناك مجالا لتطبيق التخفيف بسبب خوف فوت رفقة السفر على الواقع المعاصر خاصة في مجال السفر الجماعي، المتمثل بالرحلات المنظمة لوسائل النقل المعاصرة من طائرات وسفن وقطارات وحافلات ونحوها من الوسائل.
