يتضمن مصطلح التجارة العادلة نشاط ذات مفاهيم سياسية واجتماعية واقتصادية تهدف إلى تحقيق الأرباح من خلال الاتفاق مع المنتجين على شراء محاصيلهم الزراعية ومنتجاتهم اليدوية، التي تخضع للمعايير التي تضعها منظمة التجارة العادلة والتي تحقق المبادئ الأخلاقية والدينية، من عدم استعباد العمال واستغلال الأطفال والمحافظة على البيئة من المبيدات وكل ما يضر بها وبصحة الإنسان، مع بناء علاقة شراكة طويلة الأجل تقوم على تجدد تلقائي للعقد المبرم بينهم وبأفضل الأسعار التي تخلق للمنتج حالة من الاستقرار الاقتصادي ومن ثم المعيشي، وللمستهلك حالة من الرضا على نوعية المنتج من ناحية مادية ومن ناحية معنوية وفق الأسلوب المتبع بالإنتاج؛ لذا كان لابد من دراسة التجارة العادلة لمعرفة الوصف القانوني الذي تقوم عليه ومن ثم الآثار المترتبة عليها، سيما وإن التداخلات التي تثيرها المعايير الواجب تطبيقها في الإنتاج قد توجد لبساً في الوصف القانوني للعلاقة بين منظمة التجارة العادلة والمنتج، وبعد تحديد الوصف يتم تناول التزامات كل من الطرفين خاصة تلك التي تعطي خصوصية لهذا العقد، وأرجو أن أكون وفقت في ذلك.
The fair trade term implies some political, social, and economic concepts which aim to achieve some profits through making an agreement with the producers to buy their crops and handcraft products which are subject to the standards of fair trade association based on some moral and religious principles such as preventing the enslaving of workers, the exploitation of children, and keeping the environment away from pesticides and whatever hurts human health together with establishing a long-term relation founded on an automatic renewal of the contract signed between them in best prices that create, for the producers, a state of economic stability followed by living stability, and for the consumer a state of satisfaction of the kind of the product according to the acknowledged style of production. Therefore, it is necessary to study this legal interpretation of fair trade to arrive at the legal explanation it is based on, and then to discover the resulting effects of this relation keeping in mind that the overlapping resulted from the standards which are supposed to be applied in the production might lead to misinterpreting the legal description to the relation between the fair trade association and the producer after identifying the description and the obligations of each party particularly those which give the contract a special character.
