المستخلص: قاعدة الرخص لا تناط بالمعاصي مهمة ينبغي الاعتناء بها؛ للإحاطة بمسائلها ومستجداتها الفقهية، وقد تناولتها بالتعريف، والتحليل، وبيان مكانتها، وأدلتها، وإيضاحها بما يناسبها من الفروع المخرجة عليها؛ محققة ومدعمة بالأدلة بما يقع به المطلوب. وأودعت استثناءاتها، وفروقها، وما فيه بحث دقيق ونظر أنيق مبحثا يليق بها، فانتظم عقدها في: مقدمة، وأربعة مباحث، وخاتمة، وقد تضمنت المقدمة: أهمية الموضوع، وسبب اختياره ، والدراسات السابقة، ومنهج البحث وشمل المبحث الأول: معنى القاعدة، ومكانتها، وأدلتها ، في ثلاثة مطالب والمبحث الثاني: ضبط معاقد الفروع. والمبحث الثالث: تطبيقات القاعدة والمبحث الرابع: لواحق وتتمات يذيل بها ما تقدم بها. وفيه تنبيهات. وختم البحث بنتائج الدراسة، وتوصياتها، ومنها: تأثر قاعدة: الرخص لا تناط بالمعاصي بالاختلاف في الفروع الفقهية، وضبطها للأحكام التي يتساهل فيها كثير من الناس بحجة التيسير والتسهيل؛ بما لا يتوافق مع مقاصد الشريعة، وتناولها لجملة من الفروع الفقهية في العبادات -وهو الغالب-، وغيرها من مضامين الفقه الإسلامي، والنوازل المعاصرة. وأوصت الباحثة بدراسة القواعد الفقهية دراسة جماعية وافية؛ من خلال الموسوعات، وربطها بفقه الواقع، ومقاصد الشريعة الإسلامية، وعقد المؤتمرات الخاصة بتطبيقها عليها في موضوعات محددة؛ كفقه الأولويات، وفقه البيئة، وفقه الواقع. وأحمد الله على آلائه ونعمه. اللهم لا أحصي ثناء عليك، أنت كما أثنيت على نفسك

The rule of permissibility that cannot assign to the sins is an important task that must be given attention ; to deal with its issues and its jurisprudence developments. It has dealt with definition, analysis, statement of position, evidence, and clarification of the appropriate subjects. That was verified and supported with the evidence by what is required. Its exceptions, topics, careful research, and elegant view were deposited an appropriate topic, that consisted of introduction, four topics, and conclusion.
The introduction included: the importance of the topic, the reason for its selection, previous studies, and the research methodology. The first topic included the meaning of the base, its status, its importance, and the evidence, in three parts. The second topic: control of their rules. The third topic: the applications of the rule. The fourth topic: the accessories and the complement that provide which is antedated, and the alerts. The study concludes with the results of the study and its recommendations, including: The impact of the base: the possibilities that that cannot assign to the sin in different in the jurisprudence topics, and the control of the provisions in which many people go easy for the ease and facilitation; that was against to other contents of Islamic jurisprudence, and it dealt a sentences of the jurisprudence topics in the worship, in the majority, and other Islamic jurisprudence implications, and the contemporary events. The female researcher recommended studying the rules of jurisprudence in a comprehensive collective study; through encyclopedias, and linked it with the Islamic jurisprudence of reality, and conferencing that related to their application in specific subjects, as the priorities, environment, and reality jurisprudence, and thank Allah for his vessels and blessings. O Allah, we cannot count praise on you, as you have praised yourself.
