|a تعد التشريعات الوضعية الأداة التي بواسطتها يمكن حل المعضلات في مختلف مجالات الحياة إلا أن التشريعات في فلسطين كغيرها من البلدان لازالت قاصرة عن معالجة المشكلات الموجودة في المجتمع والسبب في ذلك هو عدم تحديد الأولويات بناء على القضايا التشريعية الأكثر أهمية وتهميش دور البحث العلمي في تحديد المشكلات ذات الأولوية. وتأتى هذه الدراسة لتحدد أولويات البحث العلمي في التشريع الفلسطيني من خلال الاعتماد على عدد من المعايير والأسس التي يتم بها تحديد الأولويات التشريعية كما أظهرت الدراسة الجهات المختصة بتحديد الأولويات وأهم الحقائق والأدلة اللازمة لصياغة تشريعات تساهم في حل المشكلات المجتمعية كما أشارت الدراسة للمعوقات العامة والخاصة للبحث العلمي ثم خلص الباحث إلى عدد من النتائج والتوصيات التي تساعد الجهات المختصة في تحديد أولويات البحث العلمي في مجال التشريع الفلسطيني.
|b The positive legislation is the tool by which problems in different areas of life can be solved. However, the legislation in Palestine, like other countries still falls short of addressing the problems in society. The reason for this is: The lack of prioritization based on the most important legislative issues, and marginalizing the role of scientific research in determining the problems priorities. This study determined the priorities of scientific research in Palestinian legislation by relying on number of criteria and principles that are identifying legislative priorities. The study also showed the authorities, who have the right to determine: the priorities, the most important facts, and the necessary evidence for drafting legislations which contribute in solving the societal problems. The study also indicated the public and private constraints of scientific research. Finally, the researcher concluded by number of findings and recommendations that will help the competent authorities in determining the priorities of scientific research in the field of Palestinian legislation.
