المستخلص: The establishment of the International Criminal Court, as a permanent and independent international judicial organ to investigate the most serious international crimes, is considered to be a landmark achievement. However, despite this important role that we hope the International Criminal Court will play, there are nevertheless several obstacles that limit the chances of the principle of non-impunity; the most significant of which are the authorities and powers invested in the UN Security Council set out by the Rome Statute. This study has been undertaken to assess the work of the International Criminal Court, within the scope of determining its relationship with the Security Council, to determine the extent to which these authorities and powers of the Council affect the independence and effectiveness of the Court.

إن إنشاء المحكمة الجنائية الدولية، كجهاز قضائي دولي دائم ومستقل، لمباشرة التحقيق في الجرائم الدولية الأشد خطورة، يعد إنجازا بارزا، ولكن وعلى الرغم من هذا الدور المهم الذي نأمل أن تقوم به المحكمة الجنائية الدولية، إلا أن هناك عدة عراقيل تحد من فرص مبدأ عدم الإفلات من العقاب، أهمها سلطات وصلاحيات مجلس الأمن الدولي المنصوص عليها في نظام روما الأساسي. فكانت هذه الدراسة لتقييم عمل المحكمة الجنائية الدولية، في نطاق تحديد العلاقة بينها وبين مجلس الأمن، للوقوف على مدى تأثير هذه السلطات وهذه الصلاحيات للمجلس على استقلالية وفعالية المحكمة.

La création de la Cour pénale internationale, un tribunal d'un international permanent et indépendant, d'enquêter directement les plus graves des crimes internationaux, est une réalisation remarquable mais en dépit de cela, le rôle important que nous espérons être fait par la Cour pénale internationale, mais il y a plusieurs obstacles limitent les chances du principe de nonimpunité, les pouvoirs les plus importants du Conseil de sécurité des Nations Unies prévues dans le Statut de Rome. Cette étude était d'évaluer le travail de la Cour pénale internationale, pour déterminer la portée de la relation entre eux et le Conseil de sécurité, afin de déterminer l'ampleur de l'impact de ces pouvoirs et autorités du Conseil sur l'indépendance et l'efficacité de la Cour.
