المستخلص: لقد كان إنشاء المحكمة الجنائية الدولية في17 جويلية 1998، حدثا قانونيا رائدا في تاريخ البشرية جمعاء، فهي أول محكمة جنائية دولية دائمة، تقيم شعائر العدالة لمقترفي جرائم الحرب، وجرائم ضد الإنسانية، وجرائم الإبادة. وقد وضع لهذه المحكمة نظاما أساسيا، يتكون من مائة وثمانية وعشرون مادة، وقد أعطت المادة 13/ب من هذا النظام لمجلس الأمن، الحق في إحالة أي حالة تتضمن ارتكاب جريمة تدخل في اختصاص المحكمة إلى المدعي العام، متصرفا حيال ذلك بموجب الفصل السابع من الميثاق، وكل قرار يصدره مجلس الأمن لا بد له من آثار ينتجها في مواجهة الخاطبين به. وأحاول في هذه الدراسة أن ألقي الضوء على آثار هذه السلطة التي يملكها مجلس الأمن على نشاط وفعالية المحكمة الجنائية الدولية، بغية الوصول إلى جدوى منح المجلس هذا الاختصاص وعما إذا كان من الضروري الإبقاء عليه.
