المستخلص: It is known that the law authorizes a person who is facing an attack on his life, wealth, or property to defend such an attack to eliminate the possible harm. This is what is known as the state of legitimate defense. However, in the course of such defence, which is guaranteed to him by law, it is conceivable that he may go beyond what is necessary to defend the danger and therefore cross the boundaries of the framework permitted to him. If he inflicted greater harm than what he might have faced, he would then be exceeding the boundaries of his defense.

Il est connu que la loi permet à celui qui est en danger pour lui ou pour sa richesse ou de son honneur de stoppé cette attaque est d’empêché la perception du risque, ce qui est connu comme la situation de légitime défense, mais au cours de ce comportement qui est garanti par la loi, il ce peut que cet personne inflige un dommage plus grave que prévu dépassant ainsi les limites de sa défense. Alors quelle est la position du droit positive ou du doit islamique envers cette situation ?

من المعروف بأن القانون يجيز لمن حل به خطر على نفسه أو ماله أو عرضه أن يقوم بدفع هذا الاعتداء لوقف الخطر المتوقع، وهذا ما يعرف بحالة الدفاع الشرعي، إلا أنه وأثناء قيام هذا الشخص بممارسة هذا السلوك الذي كفله له القانون، فمن المتصور بأن يتمادى لأكثر مما هو مستوجب لرد الخطر، ويكون بذلك قد خرج عن الإطار المسموح له، ذلك أنه أوقع ضرر أكبر من الضرر المتوقع حدوثه عليه في حالة وقوع الخطر فيكون بذلك متجاوزاً لحدود دفاعه.
