المستخلص: تبدو مشكلة الموازنة بين حماية الموارد الطبيعية من جهة واستغلالها بما يخدم التنمية المستدامة من جهة أخرى، للوهلة الأولى مشكلة مستعصية، لأنها تجمع بين متناقضين وهما حماية الموارد واستغلالها، لذلك وجب تناول الموضوع في إطار الإشكالية التالية: إلى أي مدى وُفق المشرع الجزائري في تحقيق التوازن بين متطلبات حماية الموارد الطبيعية وضرورات استغلالها بما يخدم التنمية المستدامة؟ وهي إشكالية تقتضي الإجابة عنها تحديد مفهوم الموارد الطبيعية والاطلاع على مختلف القوانين الوطنية التي تنظم استغلال هذه الموارد وتضمن حمايتها، من خلال محورين يتضمن الأول الإطار المفاهيمي لحماية الموارد الطبيعية ويتضمن الثاني الوسائل القانونية الوقائية لحماية الموارد الطبيعية في إطار التنمية المستدامة.

Le problème que pose l'équilibre entre la protection des ressources naturelles d'une part, et leur exploitation de manière qui servirait le développement durable d'autre part, semble de prime-abord un problème difficile à résoudre, étant donné qu'il réunit deux concepts contradictoires qui sont la protection des ressources et leur exploitation. Il est donc judicieux de traiter le sujet dans le cadre de la problématique suivante: Dans quelle mesure le législateur Algérien est-il parvenu à atteindre l'équilibre entre les exigences de protection des ressources naturelles et les nécessités de leur exploitation de sorte à servir le développement durable? Répondre à cette problématique nécessite de définir le concept des ressources naturelles ainsi que de prendre connaissance des différentes lois nationales régissant l'exploitation de ses ressources et garantissant leur protection, à travers deux axes dont le premier comporte le cadre conceptuel de la protection des ressources naturelles tandis que le second contient les moyens juridiques préventifs de protection des ressources naturelles dans le cadre du développement durable.

The problem of balancing the protection of natural resources with the use of sustainable development, on the other hand, seems at first glance to be an intractable problem, because it combines two contradictory aspects: the protection and the exploitation of resources, therefore, the subject should be dealt with in the context of the following problem: To what extent has the Algerian legislator agreed to balance the requirements of the protection of natural resources with the necessities of exploiting them to serve sustainable development? It is a problem that needs to be answered by defining the concept of natural resources and reviewing the various national laws that regulate the exploitation and protection of these resources from two angles. The first includes the conceptual framework for the protection of natural resources and the second includes preventive legal means to protect natural resources in the framework of sustainable development.
