يهدف هذا البحث إلى توضيح مفهوم مدرسة الأصوليين من المتكلمين وبيان من تنسب إليه هذه المدرسة، واستقصاء خصائصهم في منهجهم من خلال مؤلفاتهم، وكيفية إقامتهم بنيانهم الأصولي، والاستفادة من هذا البحث في فهم مدرستهم ومنهجهم، وتهذيب المؤلفات الأصولية في العصر الحديث. ويعتبر البحث في المناهج الأصولية من الأبحاث المستجدة المهمة، لما يتطلب من استقراء لمناهج الأصوليين ومدارسهم، والمقارنة بينها، واستنتاج خصائص هذه المناهج والمدارس، وإبراز إيجابياتها وسلبياتها، وهي خطوة نأمل أن تسهم في تجديد وتطوير مسيرة أصول الفقه. وقد توصل الباحث إلى جملة من الخصائص الإيجابية والسلبية المتعلقة بمنهج الأصوليين من المتكلمين في مؤلفاتهم وأبحاثهم الأصولية.
This study aims at exploring the features of the principles of juris prudence methodology in the works of the discipline of discourse masters (Ulama’aam) and how they have established the structure of their juristic principles, this will help to understand their school and methodology and to rectify modern works on the principles of jurisprudence accordingly. Methodologically speaking, this research is considered neoclassical as it has required the researcher to induce the methodologies and schools of major jurisprudents, to compare and contrast them, and the dedyce their features highlighting their positive and negative as pects, a step that will hopefully contribute to renewing and developing the march of the principles of jurisprudence. The writer has come up with a number of positive and negative characteristics pertaining to the methodology employed by the masters of discourse in their principles of jurisprudence work.
