هذا البحث دراسة فقهية توضح أثر تعدد القراءات في حكم الخلع، لأن كل قراءة أفادت حكماً غير ما أفادته الأخرى، وقد اختلف الفقهاء فيمن يملك الخلع، فقالت طائفة: يملكه من يملك الطلاق، وقالت أخرى: يملكه الحاكم لقراءة: (إلا أن يُخافا), حيث جعل الخوف لغير الزوجين، وقالت طائفة: يملكه الزوجان، لقراءة: ﴿إلا أن يَخافا﴾, أي إلا أن يخاف الزوج والمرأة، وتناول البحث حكم خلع الأب، والوصي، والسفيه، والمحجور عليه، والعبد، والأمة، والمكاتب والمكاتبة، والمدبر والمدبرة، والقِن، وأم الولد، والمريضة، والمريض، والمعتوه، والمغلوب على عقله، والمفلس، والصبي، والصغيرة، والحكمان.
In the Name of Allah, the Most Gracious , the Most Merciful, The Etiquettes and Regulations of the Khul' This research is a jurisprudential study that points out the effect of the enumeration of the recitations of the Holy Qur'an on the ruling of khul'; As every recitation refers to a ruling other than that of the other recitation. Scholars differed in who possesses the khul'. A group of them said: whoever possesses the right to divorce has that of khul'. Another group said: it is in the hand of the ruler, due to the recitation "illa an yukhafa" for the fear is not of the couple. A third group said: it the right of both husband and wife, due to the recitation:"illa an yakhafa" i.e' except if the husband and wife fear (that they cannot apply the rulings of Allah in their marital life). The research handles the ruling on the khul' of the father, the custodian, the idiot, the interdicted, the male and female slaves, the sick, the bankrupt, the boy, the girl, and that of the two judges.
