يتناول هذا البحث منهج التفكير الفقهي عند علماء الفقه الإسلامي في إيجاد البدائل الحقيقية للتأمينات التجارية عندما تبين أن هذه التأمينات تحقق نوع من التكافل الاجتماعي إلا أن الوسيلة التي تتبعها لا تتفق وتشريعات الدين الإسلامي لذا كان لا بد من إيجاد بديل يحقق نفس الغرض من التأمين ولكن بطريقة يبتعد فيها الإنسان عن كل ما يشوبه مخالفة شرعية, وتكمن أهمية هذا الموضوع في بيان الطريقة التي يمكن من خلالها إيجاد البدائل سواء بطريق الاستحسان أم المصلحة أم غيرها من الطرق التي تُعتمد لإضفاء الصفة الشرعية على الأحكام. وقد خلص هذا البحث إلى جملة من النتائج لعل من أهمها: أن منهج التفكير المقاصدي هو الأساس في إيجاد الحلول لقضايا فقهية معاصرة, وإيجاد بدائل يمكن لها أن تحل محل التأمين وتحقق نفس الأهداف, وإن إضافة صورة جديدة، من صور التكافل، الذي ندبت الشريعة إلى تحقيقه، في كل مجتمع إسلامي في هذه البدائل دون قيود يعد من باب التعاون وتحقيق جانب التبرع المحمود
